أعلنت الهيئة الإدارية للمحكمة الجنائية الدولية تعليق مهمات المدعي العام للمحكمة، كريم خان، وذلك عقب انتهاء مرحلة من الإجراءات التأديبية المرتبطة باتهامات تتعلق بسوء سلوك جنسي.
وجاء القرار مساء (الإثنين) بعد تصويت اللجنة التنفيذية التابعة للهيئة الحاكمة للمحكمة على إحالة القضية إلى جلسة خاصة للدول الأعضاء، البالغ عددها 125 دولة، للنظر في مستقبل خان وإمكانية اتخاذ إجراءات إضافية بحقه.
وبحسب صحيفة «الغارديان»، خلصت لجنة تضم ممثلين عن 21 دولة عضو في المحكمة، بأغلبية مؤهلة، إلى أن خان ارتكب «سوء سلوك جسيمًا» فيما يتعلق بالاتهامات الموجهة إليه.
وكان خان، وهو محامٍ بريطاني بارز يتولى منصب المدعي العام للمحكمة الجنائية الدولية، قد نفى مرارًا وتكرارًا جميع الاتهامات التي ظهرت لأول مرة عام 2024، وأثارت جدلًا واسعًا داخل المؤسسة القضائية الدولية. وقد تقدمت بالشكوى موظفة كانت تعمل تحت إشرافه في مقر المحكمة بمدينة لاهاي الهولندية.
وتُعد إحالة القضية إلى الدول الأعضاء خطوة غير مسبوقة في تاريخ المحكمة، إذ قد تفضي إلى تصويت رسمي بشأن إقالة المدعي العام من منصبه.
وأكدت الهيئة الحاكمة للمحكمة، في بيان رسمي، أن قرار التعليق لا يمثل حكمًا نهائيًا على القضية أو مؤشرًا على النتيجة النهائية للإجراءات الجارية. وكان خان قد تنحى مؤقتًا في وقت سابق عن إدارة مكتب الادعاء العام بالمحكمة إلى حين استكمال التحقيقات.
وأوضحت الهيئة أن اللجنة التنفيذية استندت في قرارها إلى تقرير صادر عن جهة رقابية تابعة للأمم المتحدة، إضافة إلى توصيات قدمتها لجنة من الخبراء القضائيين، فضلًا عن مذكرات خطية قُدمت من الأطراف المعنية، ويُعتقد أنها شملت إفادات من خان ومن مقدمة الشكوى.
وتُعد هذه الخطوة أحدث تطور في قضية شغلت المحكمة الجنائية الدولية لنحو عامين، وسط تدقيق متزايد في آليات المساءلة داخل المؤسسة.
وتتعلق الاتهامات بسلوك يُزعم أن خان مارسه خلال الفترة بين عامي 2023 و2024، حيث قالت الموظفة المشتكية إنه تورط في ممارسات جنسية قسرية وغير قائمة على التراضي على مدى فترة زمنية ممتدة. ووفقًا للادعاءات، وقعت بعض الحوادث المزعومة في غرف فنادق أثناء رحلات عمل، وكذلك داخل مكتبه الرسمي ومنزله الخاص.
في المقابل، أكد فريق الدفاع القانوني عن خان في تصريحات سابقة أنه «ينفي بشكل قاطع» جميع المزاعم، مشددًا على أنه لم يتحرش بأي شخص أو يسيء معاملته، ولم يستغل منصبه أو سلطاته، كما لم ينخرط في أي سلوك يمكن اعتباره قسريًا أو استغلاليًا أو غير لائق مهنيًا.
The administrative body of the International Criminal Court announced the suspension of the court’s prosecutor, Karim Khan, following the conclusion of a phase of disciplinary proceedings related to allegations of sexual misconduct.
The decision came on Monday evening after the executive committee of the court’s governing body voted to refer the case to a special session for the member states, which number 125, to consider Khan’s future and the possibility of taking additional actions against him.
According to The Guardian, a committee comprising representatives from 21 member states of the court concluded, by a qualified majority, that Khan had committed “serious misconduct” concerning the allegations against him.
Khan, a prominent British lawyer serving as the prosecutor of the International Criminal Court, has repeatedly denied all allegations that first emerged in 2024, sparking widespread controversy within the international judicial institution. The complaint was filed by an employee who worked under his supervision at the court’s headquarters in The Hague, Netherlands.
Referring the case to the member states is an unprecedented step in the court’s history, as it could lead to an official vote on the prosecutor’s removal from office.
The court’s governing body confirmed in an official statement that the suspension decision does not represent a final judgment on the case or an indication of the final outcome of the ongoing proceedings. Khan had temporarily stepped down earlier from managing the prosecution office until the investigations were completed.
The governing body explained that the executive committee based its decision on a report from a UN oversight body, in addition to recommendations provided by a committee of legal experts, as well as written submissions from the parties involved, which are believed to have included testimonies from Khan and the complainant.
This step is the latest development in a case that has occupied the International Criminal Court for nearly two years, amid increasing scrutiny of accountability mechanisms within the institution.
The allegations relate to behavior that Khan is said to have engaged in between 2023 and 2024, with the complaining employee stating that he was involved in coercive and non-consensual sexual practices over an extended period. According to the allegations, some of the purported incidents occurred in hotel rooms during business trips, as well as inside his official office and private home.
In response, Khan’s legal defense team stated in previous remarks that he “categorically denies” all allegations, emphasizing that he did not harass anyone or mistreat them, did not abuse his position or authority, and did not engage in any behavior that could be considered coercive, exploitative, or unprofessionally inappropriate.
