وفقاً لتصريح مدير عام الجوازات اللواء صالح المربع، سيتمكن مخالفو أنظمة الإقامة من الاستفادة من نموذج الترحيل الذاتي عبر منصة رقمية ستُطلق قريباً، تُمكِّن المخالف من إنهاء إجراءات الترحيل ذاتياً والتوجُّه إلى المنافذ للمغادرة !
تهدف منصة الترحيل الذاتي إلى الاستغناء عن سياسة الترحيل التقليدية التي تضع أعباءً ماليةً واقتصاديةً وصحيَّةً على كاهل الحكومة، كما أنها تشجِّع الراغبين في الرحيل على المغادرة الطوعية دون قلق من التعرض لإجراءات التوقيف والترحيل !
ومع ذلك، من المهم أن تراعي المنصة أيَّ حقوق مترتِّبة على المخالفين تجاه الكفيل أو غيره، بما يضمن الحقوق ويحقّق العدالة. فالمخالف لا يجوز أن تتاح له فرصة التملُّص من التزاماتِه تجاه حقوق الآخرين. وإذا كانت المنصة – كما أتوقع – سترتبط ببيانات الجهات العدلية والأمنية في القضايا والبلاغات المسجَّلة، فستُثار مسائل تتعلَّق بالتزامات وحقوق قد لا تكون مسجَّلة في بلاغاتٍ أو قضايا منظورة، ومن هنا، لا بُدَّ أن يتلقَّى الكفيل إشعاراً برغبة المخالف في الترحيل الذاتي، مع ضرورة أن يتحمَّل المخالف تكاليف وقيمة تذكرة وسيلة مغادرته؛ فالمخالف لا يجب أن يكافأ بالرحيل مجَّاناً، والكفيل لا يجب أن يُعاقب بسبب إخلال المكفول بعلاقة العمل التعاقدية !
تسهيل خروج المخالفين – ما لم تترتَّب عليهم جرائم موجبة للمحاكمة – لا يخفض تكاليف سياسة الترحيل على الدولة فحسب، بل يحقِّق أيضاً مضامينَ أمنيَّةً واجتماعيَّةً واقتصاديَّةً بالغة الأهميّة. فهؤلاء المخالفون قد يكونون نقاطَ ضعفٍ في أمن المجتمع ومصدرَ نزفٍ للقانون والاقتصاد !
According to the statement of the Director General of Passports, Major General Saleh Al-Murabba, violators of residency regulations will be able to benefit from the self-deportation model through a digital platform that will be launched soon, enabling violators to complete the self-deportation procedures and head to the exit points for departure!
The self-deportation platform aims to eliminate the traditional deportation policy that places financial, economic, and health burdens on the government, and it also encourages those wishing to leave to do so voluntarily without the fear of being subjected to detention and deportation procedures!
However, it is important for the platform to consider any rights owed by the violators to the sponsor or others, ensuring rights are upheld and justice is achieved. A violator should not be given the opportunity to evade their obligations towards the rights of others. If the platform— as I expect— will be linked to the data of judicial and security authorities regarding recorded cases and reports, issues related to obligations and rights that may not be recorded in reports or pending cases will arise. Therefore, the sponsor must receive a notification of the violator’s desire for self-deportation, and the violator must bear the costs and value of their means of departure; the violator should not be rewarded with free departure, and the sponsor should not be penalized due to the breach of the contractual employment relationship by the sponsored individual!
Facilitating the exit of violators—unless they are involved in crimes warranting prosecution—does not only reduce the costs of the deportation policy on the state, but also achieves significant security, social, and economic implications. These violators may represent vulnerabilities in community security and a source of legal and economic drain!
