قررت جهات التحقيق في مصر، اليوم (الثلاثاء)، إحالة 8 من القيادات السابقة لحيي «مصر الجديدة» و«النزهة» إلى المحكمة التأديبية لمستوى الإدارة العليا، وذلك على خلفية ثبوت قبولهما وأخذهما عطايا مالية وسبائك ذهبية على سبيل الرشوة، مقابل أداء أعمال من أعمال وظائفهم أو الإخلال بواجباتها.
وبحسب بيان صادر عن هيئة النيابة الإدارية، شملت قائمة المحالين رئيس حي «مصر الجديدة» السابق، ومديرة منطقة الإسكان السابقة، ومدير التنظيم السابق، ومهندس التنظيم السابق بالحي، كما شملت رئيس حي «النزهة» السابق، ومديرة منطقة الإسكان السابقة، ومدير التنظيم السابق، ومهندس التنظيم السابق بحي «النزهة».
وكشفت التحقيقات أن المتهمين من الأول إلى الرابع -كل فيما يخصه ووفق اختصاصه الوظيفي- قبلوا وأخذوا مبالغ مالية على سبيل الرشوة مقابل أداء أعمال وظيفية، تمثلت في إصدار رخصة بناء لقطعة أرض ضمن نطاق حي «مصر الجديدة»، واعتماد وقبول طلبات تصالح لعدد من العقارات السكنية، واعتماد طلبات توصيل المرافق وطلبات التشطيب لعدد من العقارات المخالفة بنطاق الحي.
أما المتهمون من الخامس إلى الثامن، فقد قبلوا وأخذوا مبالغ مالية على سبيل الرشوة نظير الإخلال بواجبات وظائفهم، من خلال الامتناع عن اتخاذ الإجراءات القانونية المقررة حيال إيقاف الأعمال المخالفة لعدد من العقارات، والتي تمثلت في: تعلية طوابق بالمخالفة للاشتراطات البنائية، وإجراء تعديلات جوهرية على بعض الطوابق بالمخالفة للترخيص الصادر، فضلاً عن تعديل النشاط لبعض الوحدات دون الحصول على التراخيص اللازمة.
كما ثبت أن رئيس جهاز التفتيش الفني على أعمال البناء التابع لوزارة الإسكان سابقاً قد قبل وأخذ عطية عبارة عن ثلاث سبائك ذهبية، نظير إصدار خطابين: الأول موجه لمحافظة القاهرة، والثاني موجه لرئاسة حي «مصر الجديدة»، لإصدار رخصة بناء ضمنية على قطعة الأرض المذكورة.
واشترك عضو اللجنة الفنية المختصة بالدراسة والبت في طلبات التصالح عن مخالفات البناء بحي «مصر الجديدة» سابقاً، بطريق الاتفاق والمساعدة مع مجهول، في تزوير محررات رسمية منسوب صدورها لجهات رسمية، واستعمالها ضمن مستندات طلبات التصالح على خلاف الحقيقة.
واطلعت النيابة على الحكم الصادر من محكمة الجنايات المختصة، والذي قضى بمعاقبة المتهمين بالسجن المشدد لمدة 10 سنوات، وتغريمهم مبالغ مالية قاربت 3 ملايين ونصف مليون جنيه، مع مصادرة السبائك الذهبية المضبوطة ومصادرة المحررات المزورة.
وفور عرض نتائج التحقيقات على رئيس هيئة النيابة الإدارية المستشار محمد الشناوي، أمر بإحالة المتهمين جميعاً إلى المحاكمة التأديبية أمام المحكمة التأديبية لمستوى الإدارة العليا.
كما أمر بإخطار رئيس مجلس إدارة المركز القومي لبحوث الإسكان والبناء لاتخاذ ما يلزم تأديبياً بشأن مسؤولية رئيس جهاز التفتيش الفني على أعمال البناء سابقاً -الباحث المتفرغ بمعهد بحوث العمارة والإسكان بالمركز- في ضوء ما انتهى إليه حكم محكمة الجنايات المختصة، وكذلك إخطار رئيس مجلس نقابة المهندسين لاتخاذ الإجراءات التأديبية حيال المهندس المدني عضو اللجنة الفنية المختصة بالدراسة والبت في طلبات التصالح عن مخالفات البناء بحي «مصر الجديدة» سابقاً، في ضوء ما انتهى إليه حكم محكمة الجنايات المختصة.
The investigative authorities in Egypt decided today (Tuesday) to refer 8 former leaders of the “Heliopolis” and “Nozha” districts to the disciplinary court for senior management, following evidence that they accepted and received financial gifts and gold bars as bribes in exchange for performing their job duties or neglecting them.
According to a statement issued by the Administrative Prosecution Authority, the list of those referred includes the former head of the “Heliopolis” district, the former director of the housing area, the former director of organization, and the former organization engineer in the district. It also includes the former head of the “Nozha” district, the former director of the housing area, the former director of organization, and the former organization engineer in the “Nozha” district.
The investigations revealed that the defendants from the first to the fourth – each concerning their respective roles and job responsibilities – accepted and received financial amounts as bribes in exchange for performing job duties, which included issuing a building permit for a piece of land within the “Heliopolis” district, approving and accepting reconciliation requests for several residential properties, and approving requests for utility connections and finishing requests for several violating properties within the district.
As for the defendants from the fifth to the eighth, they accepted and received financial amounts as bribes in exchange for neglecting their job duties by refraining from taking the legal measures required to stop the violating works on several properties, which included: raising floors in violation of building regulations, making substantial modifications to some floors in violation of the issued permit, as well as changing the activity of some units without obtaining the necessary licenses.
It was also established that the head of the technical inspection authority for construction works, previously affiliated with the Ministry of Housing, accepted and received a gift consisting of three gold bars in exchange for issuing two letters: the first addressed to the Governor of Cairo, and the second addressed to the presidency of the “Heliopolis” district, to issue an implicit building permit for the mentioned piece of land.
A member of the technical committee responsible for studying and deciding on reconciliation requests for building violations in the “Heliopolis” district previously conspired and assisted an unknown person in forging official documents attributed to official authorities and used them among the documents for reconciliation requests contrary to the truth.
The prosecution reviewed the ruling issued by the competent criminal court, which sentenced the defendants to 10 years of hard labor and fined them amounts close to 3.5 million Egyptian pounds, along with confiscating the seized gold bars and the forged documents.
As soon as the results of the investigations were presented to the head of the Administrative Prosecution Authority, Counselor Mohamed El-Shenawy, he ordered the referral of all defendants to disciplinary trial before the disciplinary court for senior management.
He also ordered notifying the chairman of the National Center for Housing and Building Research to take the necessary disciplinary actions regarding the responsibility of the former head of the technical inspection authority for construction works – a full-time researcher at the Institute of Architecture and Housing Research at the center – in light of the conclusions reached by the ruling of the competent criminal court, as well as notifying the chairman of the Engineers Syndicate to take disciplinary measures against the civil engineer who is a member of the technical committee responsible for studying and deciding on reconciliation requests for building violations in the “Heliopolis” district previously, in light of the conclusions reached by the ruling of the competent criminal court.
