
أكد عضو علماء الأزهر الدكتور علي جمعة أنه إذا قام المسلم الصائم بمعاشرة زوجته معاشرة جنسية في نهار رمضان بطل صومه، ووجب عليه القضاء والكفارة؛ لما ورد أَنَّ رَجُلاً جَاءَ إِلَى النَّبِيِّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ، وَقَالَ لَهُ: هَلَكْتُ يَا رَسُولَ اللهِ، قَالَ: «وَمَا أَهْلَكَكَ؟» قَالَ: وَقَعْتُ عَلَى امْرَأَتِي فِي رَمَضَانَ، فَقَالَ الرَّسُولُ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «هَلْ تَجِدُ مَا تُعْتِقُ بِهِ رَقَبَةً؟» قَالَ: لَا، قَالَ: «فَهَلْ تَسْتَطِيعُ أَنْ تَصُومَ شَهْرَيْنِ مُتَتَابِعَيْنِ؟» قَالَ: لَا، قَالَ: «فَهَلْ تَجِدُ مَا تُطْعِمُ سِتِّينَ مِسْكِيناً؟» قَالَ: لَا، ثُمَّ جَلَسَ الرَّجُلُ فَجَاءَ إِلَى النَّبِيِّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ مِكْيَالٌ فِيهِ تَمْرٌ، فَقَالَ النَّبِيُّ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ لِلرَّجُلِ: «تَصَدَّقْ بِهَذَا»، قَالَ: مَا بَيْنَ لَابَتَيْهَا -طَرَفَيْهَا- أَهْلُ بَيْتٍ أَحْوَجُ إِلَيْهِ مِنِّي، فَضَحِكَ النَّبَيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ، وَقَالَ لِلرَّجُلِ: «اذْهَبْ فَأَطْعِمْهُ أَهْلَكَ».
ولفت إلى أن كثيراً من الفقهاء يرون أن الكفارة واجبة على الزوج وحده إذا لم يكن ناسياً، وتكون الكفارة على الترتيب الذي ذكره الحديث: فيلزمه عتق الرقبة إن استطاع إلى ذلك سبيلاً، فإن لم يستطع فعليه صيام شهرين متتابعين، فإن عجز أطعم ستين مسكيناً من أوسط ما يطعم أهله.
Dr. Ali Gomaa, a member of the Al-Azhar scholars, confirmed that if a fasting Muslim has sexual relations with his wife during the day in Ramadan, his fast is invalidated, and he must make up for it and perform expiation. This is based on the narration that a man came to the Prophet, peace be upon him, and said: “I am ruined, O Messenger of Allah.” The Prophet asked, “What has ruined you?” He replied, “I had intercourse with my wife during Ramadan.” The Messenger, peace be upon him, said: “Do you find anything to free a slave?” He said: “No.” The Prophet asked, “Can you fast for two consecutive months?” He said: “No.” The Prophet then asked, “Do you find anything to feed sixty needy people?” He said: “No.” Then the man sat down, and a container of dates was brought to the Prophet, peace be upon him. The Prophet said to the man: “Give this as charity.” The man replied: “Between its two sides – its ends – there are people of my household who are more in need of it than I am.” The Prophet, peace be upon him, laughed and said to the man: “Go and feed your family.”
He pointed out that many jurists believe that the expiation is obligatory solely on the husband if he was not forgetful. The expiation follows the order mentioned in the hadith: he must free a slave if he has the means to do so; if not, he must fast for two consecutive months; and if he is unable, he must feed sixty needy people from the average of what he feeds his family.
