أصدرت المحكمة الإدارية العليا بمجلس الدولة في مصر، حكمها برفض الطعن رقم 13594 لسنة 70 قضائية المقدم من موظفة بإحدى مديريات التربية والتعليم، مؤكدة صحة الحكم التأديبي القاضي بفصلها من الخدمة بعد ثبوت تقديم شهادتين مزورتين خلال عامي 2017 و2018، بهدف تسوية وضعها الوظيفي والحصول على وظيفة كاتب رابع.
إخلال جسيم بالواجبات
وأكدت المحكمة أن ما ارتكبته الموظفة يمثل إخلالًا جسيمًا بواجبات الوظيفة العامة ومساسًا مباشرًا بكرامة العمل الإداري، موضحة أن مثل هذه التصرفات تقوض ثقة الدولة في العاملين بالجهاز الإداري، وتستدعي فرض جزاءات حاسمة لضمان الانضباط وصون هيبة المرافق العامة.
المسؤولية التأديبية
أضافت المحكمة أن المسؤولية التأديبية لا تقتصر على المخالفات الوظيفية المباشرة، بل تشمل أي سلوك يضر بسمعة الوظيفة أو يضعف الثقة في الجهة الإدارية، حتى لو وقع خارج نطاق العمل الرسمي، مؤكدة أن العقوبة المتخذة كانت متناسبة مع جسامة المخالفة.
صون نزاهة الأداء
وأشارت المحكمة إلى أن دورها يقتصر على مراقبة سلامة تطبيق القانون وصحة الإجراءات، دون إعادة تقييم الوقائع أو تعديل الجزاء، مؤكدة على ضرورة حماية الشهادات التعليمية والمحررات الرسمية من أي عبث، ومحاسبة كل من يتجاوز القانون، حفاظًا على نزاهة الأداء داخل مؤسسات الدولة.
The Supreme Administrative Court of the State Council in Egypt issued its ruling rejecting appeal number 13594 for the year 70 judicial, submitted by an employee from one of the directorates of education, confirming the validity of the disciplinary ruling that dismissed her from service after it was proven that she submitted two forged certificates during the years 2017 and 2018, with the aim of regularizing her employment status and obtaining the position of a fourth clerk.
Serious Breach of Duties
The court confirmed that what the employee committed represents a serious breach of the duties of public office and a direct affront to the dignity of administrative work, explaining that such behaviors undermine the state’s trust in employees of the administrative apparatus and necessitate imposing decisive penalties to ensure discipline and preserve the dignity of public facilities.
Disciplinary Responsibility
The court added that disciplinary responsibility is not limited to direct job violations, but includes any behavior that harms the reputation of the job or undermines trust in the administrative body, even if it occurs outside the scope of official work, emphasizing that the penalty imposed was commensurate with the severity of the violation.
Preserving Performance Integrity
The court pointed out that its role is limited to monitoring the proper application of the law and the validity of procedures, without re-evaluating the facts or modifying the penalty, emphasizing the necessity of protecting educational certificates and official documents from any tampering, and holding accountable anyone who violates the law, in order to maintain the integrity of performance within state institutions.
