حين فكرت في الكتابة عن هيئة الرقابة ومكافحة الفساد (نزاهة) ودورها في حماية الوطن؛ خطر على بالي سؤال فرضي: هل جميع صور استغلال النفوذ الوظيفي تعتبر فساداً؟ فهناك من يستغل السلطة للمصلحة العامة، ومن يتعرض لضغوط تدفعه – لا إرادياً – إلى استغلال النفوذ لأهداف غير شخصية.
الأمور التالية تسلِّط الضوء على ذلك الدور الوطني لنزاهة:
أولاً: «نزاهة» لا تتسامح مع كل أشكال استغلال النفوذ الوظيفي أو التناقل بين الأبواب المالية دون علم الجهات الرسمية.
ثانياً: «نزاهة» من حكمتها السِتر على اسم المُتهم في قضايا الفساد، ماعدا الحالات التي يفرضها النظام لسير التحقيق.
ثالثاً: «نزاهة» رزينة في التعامل مع الموقوفين من ذوي المناصب العليا؛ مدنيَّة أو عسكرية، تحافظ على خيط رفيع من الثقة بينها وبينهم أثناء التحقيقات، ومع ذلك تنظر للجميع وفق مبدأ المساواة أمام القانون، ولا تتهاون مع التجاوزات مهما كانت المناصب.
رابعاً: «نزاهة» كشفت قضايا غامضة الأسرار، غريبة الأطوار، ومثل هذه القضايا تحتاج قوى متوافقة تتفق على التنفيذ، وأتوقع أن تختفي هذه العمليات مع نظام الرقابة المالية الذي تم إقراره أخيراً لتنظيم وتوزيع الأدوار الرقابية على العمليات المالية في الأجهزة الحكومية.
خامساً: «نزاهة» لها مهابتها وهيبتها، ولها محاسنها وحنانيها، تُراعي مشاعر الندم عند بعض الموقوفين من الصفة الطبيعية أو الاعتبارية، ولديها قواعد للتسويات أو ما يسمى «صور العدالة الرضائية»، وتكون التسوية في حالات معينة وشروط محددة، أولها وأهمها استرداد حقوق الدولة.
سادساً: «نزاهة» تُحذر من القصد الاحتمالي، أي ترفض قول بعض المتهمين: «قضاء وقدر»، ولا تتقبل إجابة «مدري كيف حصل».
سابعاً: «نزاهة» لها ما يكون للنيابة العامة؛ تُوقف وتُباشر وتَتحرى وتتأكد وتقيم الدعوة أمام المحكمة المختصة.
When I thought about writing about the Commission for the Prevention of Corruption (Nazaha) and its role in protecting the homeland, a hypothetical question came to mind: Are all forms of abuse of power considered corruption? There are those who exploit authority for the public good, and those who face pressures that lead them – involuntarily – to misuse their influence for non-personal goals.
The following points highlight that national role of Nazaha:
First: “Nazaha” does not tolerate any forms of abuse of power or the transfer between financial doors without the knowledge of the official authorities.
Second: “Nazaha” has the wisdom to keep the names of the accused in corruption cases confidential, except in cases mandated by the system for the progress of the investigation.
Third: “Nazaha” is composed in dealing with those detained from high-ranking positions, whether civilian or military, maintaining a thin thread of trust between them during investigations, yet views everyone according to the principle of equality before the law, and does not overlook violations regardless of the positions held.
Fourth: “Nazaha” has uncovered cases shrouded in mysterious secrets, bizarre in nature, and such cases require compatible forces that agree on execution. I expect these operations to disappear with the financial oversight system that has recently been approved to organize and distribute oversight roles over financial operations in government agencies.
Fifth: “Nazaha” has its dignity and respect, and it has its merits and compassion, taking into account the feelings of regret among some detainees from natural or legal entities. It has rules for settlements, or what is called “forms of consensual justice,” and settlements occur in certain cases and under specific conditions, the first and most important of which is the recovery of state rights.
Sixth: “Nazaha” warns against probabilistic intent, meaning it rejects the statement of some defendants: “It’s fate,” and does not accept the answer “I don’t know how it happened.”
Seventh: “Nazaha” has powers similar to those of the Public Prosecution; it can detain, initiate, investigate, verify, and present the case before the competent court.
