ألغت محكمة في هونغ كونغ، اليوم (الخميس)، إدانة قطب الإعلام المؤيد للديمقراطية جيمي لاي بتهمة الاحتيال، وأسقطت حكم السجن الصادر بحقه، في قرار قانوني مفاجئ يأتي بعد فترة وجيزة من صدور حكم منفصل بسجنه 20 عامًا بموجب قانون الأمن القومي.
وقال القضاة جيريمي بون وأنتيا بانغ وديريك بانغ في ملخص الحكم إن محكمة أدنى درجة «أخطأت» في تقييمها، ومنحت لاي ومدعى عليه آخر الإذن بالاستئناف، وألغت الإدانة والعقوبة.
تفاصيل القضية
كان لاي قد حُكم عليه في ديسمبر 2022 بالسجن خمس سنوات وتسعة أشهر بعد إدانته بمخالفة شروط عقد إيجار مقر صحيفة Apple Daily، عبر إخفاء تشغيل شركة خاصة تُدعى Dico Consultants Ltd داخل المبنى، كما أُدين المدير التنفيذي في «نكست ديجيتال»، وونغ واي-كيونغ (61 عامًا)، في القضية ذاتها.
لكن محكمة الاستئناف خلصت إلى أن شركة (آبل ديلي برينتينغ) لم تكن ملزمة قانونيًا بالإفصاح عن خرق قيود الاستخدام المرتبطة بوجود شركة Dico في المقر، معتبرة أن استنتاجات القاضي السابق «غير قابلة للدعم قانونيًا».
وكان القاضي في الحكم الابتدائي قد رأى أن لاي كان على علم بضرورة الحصول على ترخيص لتشغيل الشركة داخل المقر، وأنه تصرف «تحت مظلة مؤسسة إعلامية».
من جهتها، أعلنت حكومة هونغ كونغ أن وزارة العدل ستدرس الحكم لتقرير ما إذا كانت ستتقدم بطعن جديد.
السجن مستمر رغم الانتصار
ورغم إسقاط إدانة الاحتيال، سيبقى لاي (78 عامًا) في السجن لتنفيذه حكمًا منفصلًا بالسجن 20 عامًا صدر بحقه في قضية أمن قومي، تتعلق بتهمتي «التآمر مع قوى أجنبية» ونشر مواد تحريضية.
وتُعد هذه القضية من أبرز محطات حملة تشديد أمني استمرت سنوات عقب احتجاجات 2019 المؤيدة للديمقراطية، في ظل قانون الأمن القومي الذي فرضته بكين.
ووصف لاي نفسه أمام المحكمة سابقًا بأنه «سجين سياسي»، بينما قال نجله سيباستيان لاي إن القرار الأخير «لا يغيّر شيئًا»، مضيفًا أن والده أمضى أكثر من خمس سنوات في الحبس الانفرادي داخل سجن شديد الحراسة.
مخاوف بشأن حالته الصحية
وأعربت عائلة لاي عن قلقها إزاء تدهور حالته الصحية، مشيرة إلى معاناته من انسداد وريدي شبكي في العين اليمنى، وارتفاع ضغط الدم، وخفقان القلب، وفقدان تدريجي للسمع.
ودعت منظمات حقوقية وعدد من الدول الديمقراطية إلى الإفراج عنه، كما أثار الرئيس الأمريكي دونالد ترمب القضية خلال محادثات مع نظيره الصيني، ومن المتوقع أن يعاود طرحها خلال زيارة مرتقبة إلى بكين نهاية مارس القادم.
دلالات القرار
ويُنظر إلى إلغاء إدانة الاحتيال على أنه انتصار قانوني نادر للاي في ظل سلسلة من الملاحقات القضائية، غير أن بقاء حكم الأمن القومي ساريًا يعني أن القرار لا يبدّل واقع سجنه في المدى المنظور، بينما تظل قضيته محور جدل دولي حول الحريات الإعلامية وسيادة القانون في هونغ كونغ.
A court in Hong Kong today (Thursday) overturned the conviction of pro-democracy media tycoon Jimmy Lai on fraud charges and dismissed the prison sentence against him, in a surprising legal decision that comes shortly after a separate ruling sentenced him to 20 years in prison under the national security law.
The judges Jeremy Poon, Anthea Pang, and Derek Pang stated in their summary of the ruling that a lower court “erred” in its assessment, granting Lai and another defendant permission to appeal, and overturning the conviction and sentence.
Case Details
Lai was sentenced in December 2022 to five years and nine months in prison after being convicted of violating the terms of the lease for the Apple Daily newspaper’s headquarters by concealing the operation of a private company called Dico Consultants Ltd within the building. The executive director of Next Digital, Wong Wai-keung (61 years old), was also convicted in the same case.
However, the appeals court concluded that Apple Daily Printing was not legally obligated to disclose the breach of usage restrictions related to the presence of Dico in the headquarters, considering that the previous judge’s conclusions were “legally unsupported.”
The judge in the initial ruling had determined that Lai was aware of the need to obtain a license to operate the company within the headquarters and that he acted “under the umbrella of a media organization.”
For its part, the Hong Kong government announced that the Department of Justice would review the ruling to decide whether to file a new appeal.
Prison Sentence Continues Despite Victory
Despite the overturning of the fraud conviction, Lai (78 years old) will remain in prison to serve a separate 20-year sentence handed down in a national security case concerning charges of “conspiracy with foreign forces” and publishing seditious materials.
This case is considered one of the most significant points in a years-long crackdown following the pro-democracy protests of 2019, under the national security law imposed by Beijing.
Lai previously described himself in court as a “political prisoner,” while his son, Sebastian Lai, stated that the recent decision “changes nothing,” adding that his father has spent more than five years in solitary confinement in a high-security prison.
Concerns About His Health Condition
Lai’s family has expressed concern over the deterioration of his health, noting that he suffers from a retinal vein occlusion in his right eye, high blood pressure, heart palpitations, and gradual hearing loss.
Human rights organizations and several democratic countries have called for his release, and U.S. President Donald Trump raised the issue during talks with his Chinese counterpart, with expectations that he will bring it up again during an upcoming visit to Beijing at the end of March.
Implications of the Decision
The overturning of the fraud conviction is seen as a rare legal victory for Lai amid a series of prosecutions; however, the continued validity of the national security ruling means that the decision does not change the reality of his imprisonment in the foreseeable future, while his case remains a focal point of international debate regarding media freedoms and the rule of law in Hong Kong.
