تعتزم وزارة السياحة إقرار قواعد وجدول المخالفات والعقوبات لنشاط مرفق الضيافة السياحي في مدينتَي مكة المكرمة والمدينة المنورة، خلال موسم الحج، يتضمن إلغاء الترخيص وعقوبة 50 ألف ريال عند التعاقد لتقديم الخدمة من خلال عقود غير موثقة من وزارة الحج والعمرة.
وتهدف وزارة السياحة من المشروع، إلى رفع جودة الخدمات السياحية وتعزيز الامتثال للأنظمة، وتحقيق التوازن بين الرقابة والتنمية في قطاع الضيافة السياحية خلال موسم الحج.
ونص المشروع المعتزم إقراره على أن النطاق الزمني لتطبيق هذا الجدول هو موسم الحج الذي يبدأ سنوياً في غرة ذي القعدة، وينتهي في منتصف محرم، ما لم يصدر خلاف ذلك من الجهة المختصة.
5 فئات
ووفق المقترح، قسّم المشروع مستويات الأنشطة إلى 5 فئات، إضافة إلى حجم المنشأة ما بين متناهية الصغر ونسبتها المقررة للعقوبة المالية 25%، والمنشآت الصغيرة ونسبتها 50% من العقوبة، والمتوسطة والنسبة من قيمة العقوبة المالية 75%، والمنشآت الكبيرة بلغت نسبتها 100%.
ومن المخالفات التي تضمنها المشروع عدم توفير وحدة بديلة للسائح في مكان قريب ومساوية لنوع المرفق ودرجة تصنيفه أو أعلى، أو إعادة المبالغ المالية المدفوعة له عن الليلة التي انقطعت فيها الخدمة، كالكهرباء أو الماء، للمدة المتبقية من الحجز لمدة تتجاوز ساعتين، وعقوبتها 20 ألف ريال للفئة الأولى، و15 ألف ريال للفئة الثانية، و10 آلاف ريال لبقية الفئات.
مخالفات جسيمة
ومن المخالفات التي تضمّنها الجدول عدم التحقق من أصل إثبات الهوية، بحيث يكون التحقق منها من خلال الاطلاع على أصلها وتسجيل بياناتها فقط دون أخذ صورة منها، وعقوبة الفئة الأولى غرامة 10 آلاف ريال، والفئة الثانية غرامة 8 آلاف ريال، والفئة الثالثة 6 آلاف ريال، و4 آلاف للفئة الرابعة، و2000 ريال للفئة الخامسة.
ومن المخالفات عدم الإبلاغ فوراً وبشكل مباشر الجهات المختصة والوزارة من خلال القنوات المخصصة لذلك عن أي حادثة تتعلق بالأمن والسلامة في مرفق الضيافة السياحي، وهي من المخالفات الجسيمة وفق الوزارة، وحددت غرامتها بـ10 آلاف ريال للفئة الأولى، و8 آلاف ريال للفئة الثانية، و6 آلاف ريال للفئة الثالثة، والفئة الرابعة 4 آلاف ريال، والفئة الخامسة 2000 ريال، إضافة إلى إغلاق مؤقت كلي حتى تصحيح المخالفة، ووفقاً للمدة المحددة من اللجنة (عند تكرار مخالفة العنصر ذاته للمرة الأولى).
اختلاف العقوبة
شدّد المشروع على أنه في حال اختلاف العقوبة المالية أو غير المالية الواردة في الجدول الأساسي (جدول المخالفات والعقوبات لنشاط مرفق الضيافة السياحي وقواعد تطبيقه)، فإنه يتم تطبيقها إذا كانت المخالفة التي وقعت خلال موسم الحج مكررة لمخالفة وقعت قبل موسم الحج، فيتم تطبيق الحد الأدنى للعقوبة المالية الواردة في الجدول متى كانت أعلى من سابقتها، أما إذا كانت أقل فتتم مضاعفة الحد الأدنى الوارد في هذا الجدول.
كما أكدت أنه إذا كانت المخالفة التي وقعت خلال موسم الحج مكررة لمخالفة وقعت في الموسم ذاته، فيتم تطبيق العقوبة المالية الواردة في هذا الجدول مع مضاعفتها، وإذا كانت المخالفة التي وقعت بعد الموسم مكررة لمخالفة وقعت أثناء الموسم، فتتم مضاعفة الحد الأدنى للعقوبة المالية الواردة في الجدول الأساسي حسب مرات التكرار.
وفي حال اختلفت العقوبة غير المالية في حال التكرار ووقعت المخالفة خلال الموسم فإنه يتم تطبيق العقوبة الواردة في هذا الجدول، وفي حال تكرار ارتكاب المخالفة مرتين للمخالفات التي لم تحدد لها عقوبة غير مالية -وفقاً للجدول- فللجنة تطبيق عقوبة الإغلاق المؤقت أو تعليق الترخيص خلال موسم الحج الذي وقعت فيه المخالفة، وفي حال تكرار المخالفة للمرة الثالثة فللجنة إلغاء الترخيص.
The Ministry of Tourism intends to approve rules and a schedule of violations and penalties for the activity of the tourism hospitality facility in the cities of Mecca and Medina during the Hajj season. This includes revoking the license and imposing a fine of 50,000 riyals when contracting to provide the service through undocumented contracts from the Ministry of Hajj and Umrah.
The Ministry of Tourism aims, through this project, to raise the quality of tourism services, enhance compliance with regulations, and achieve a balance between oversight and development in the tourism hospitality sector during the Hajj season.
The proposed project stipulates that the time frame for applying this schedule is the Hajj season, which annually begins on the first of Dhu al-Qi’dah and ends in the middle of Muharram, unless otherwise stated by the competent authority.
5 Categories
According to the proposal, the project divides the levels of activities into 5 categories, in addition to the size of the establishment ranging from micro to small, with a financial penalty rate of 25%, small establishments with a penalty rate of 50%, medium establishments with a penalty rate of 75%, and large establishments with a penalty rate of 100%.
Among the violations included in the project is the failure to provide an alternative unit for the tourist in a nearby location that is equivalent to the type of facility and its classification level or higher, or the failure to refund the amounts paid for the night when the service was interrupted, such as electricity or water, for the remaining duration of the reservation exceeding two hours. The penalty for this is 20,000 riyals for the first category, 15,000 riyals for the second category, and 10,000 riyals for the remaining categories.
Serious Violations
Among the violations included in the schedule is the failure to verify the original identification document, whereby verification should be done by viewing the original and recording its details only without taking a copy. The penalty for the first category is a fine of 10,000 riyals, for the second category is 8,000 riyals, for the third category is 6,000 riyals, for the fourth category is 4,000 riyals, and for the fifth category is 2,000 riyals.
Another violation is the failure to immediately and directly report to the competent authorities and the ministry through the designated channels about any incident related to security and safety in the tourism hospitality facility, which is considered a serious violation according to the ministry. The fine for this is set at 10,000 riyals for the first category, 8,000 riyals for the second category, 6,000 riyals for the third category, 4,000 riyals for the fourth category, and 2,000 riyals for the fifth category, in addition to a temporary complete closure until the violation is corrected, according to the duration specified by the committee (in case of repeating the same violation for the first time).
Difference in Penalty
The project emphasized that in the event of a difference in the financial or non-financial penalties stated in the basic schedule (the schedule of violations and penalties for the tourism hospitality facility activity and its application rules), they will be applied if the violation that occurred during the Hajj season is a repeat of a violation that occurred before the Hajj season, in which case the minimum financial penalty stated in the schedule will be applied if it is higher than the previous one. If it is lower, the minimum stated in this schedule will be doubled.
It also confirmed that if the violation that occurred during the Hajj season is a repeat of a violation that occurred in the same season, the financial penalty stated in this schedule will be applied and doubled. If the violation that occurred after the season is a repeat of a violation that occurred during the season, the minimum financial penalty stated in the basic schedule will be doubled according to the number of repetitions.
If the non-financial penalty differs in the case of repetition and the violation occurred during the season, the penalty stated in this schedule will be applied. In the case of repeating the violation twice for violations that do not have a specified non-financial penalty – according to the schedule – the committee may apply a temporary closure penalty or suspend the license during the Hajj season in which the violation occurred. If the violation is repeated for the third time, the committee may revoke the license.
