قدمت المديرية العامة للدفاع المدني مشروعاً يتضمن قواعد مقترحة لتنظيم عمل لجان الاعتراض على العقوبات والجزاءات؛ بهدف تعزيز الحوكمة وتحديد الإجراءات النظامية المتعلقة بالنظر في الاعتراضات على المخالفات.
وبحسب المشروع، تُشكَّل لجان النظر بقرار من وزير الداخلية أو من يفوضه، على أن تضم ما لا يقل عن خمسة أعضاء يتمتعون بالاستقلالية التامة عن الجهات القائمة بضبط المخالفات.
ويتيح المشروع للأفراد والمنشآت تقديم اعتراضاتهم رسمياً خلال 30 يوماً من تاريخ إبلاغهم بقرار المخالفة، على أن يتم قيد الاعتراض فوراً عبر القنوات المعتمدة في المديرية مع إشعار مقدم الطلب. وتتولى أمانة اللجنة مراجعة الطلب خلال خمسة أيام عمل للتحقق من استيفاء المتطلبات، وفي حال وجود نواقص، يُمنح المعترض مهلة إضافية مدتها خمسة أيام لاستكمالها، وإلا جاز للجنة رفض الاعتراض شكلاً.
كما تُلزم القواعد اللجنة بإصدار قرارها خلال 15 يوماً من اكتمال الطلب، مع إمكانية التمديد مرة واحدة لمدة لا تتجاوز 10 أيام بمبررات مكتوبة. ويُعد الاعتراض مرفوضاً ضمنياً إذا لم يصدر القرار خلال المدة المحددة، مما يتيح للمعترض اللجوء إلى القضاء.
ويؤكد المشروع على مبدأ الشفافية، إذ يُسمح للمعترض بالاطلاع على ملفه والحصول على نسخ من المستندات، كما يمكنه الاستعانة بخبراء معتمدين على نفقته لدعم موقفه، ويلتزم أعضاء اللجنة بالإفصاح كتابياً عن أي تضارب محتمل في المصالح، ويحق للمعترض طلب رد أي عضو، بما في ذلك رئيس اللجنة، إذا وُجد سبب مشروع يؤثر على الحياد.
وتجيز القواعد تعليق تنفيذ العقوبة مؤقتاً بناءً على طلب المعترض إذا ثبت أن التنفيذ قد يسبب له ضرراً جسيماً لا يمكن تداركه، مع استثناء المخالفات المتعلقة بالغش أو التحايل أو ما يمس الصحة العامة.
وتصدر قرارات اللجنة بالأغلبية استناداً إلى وقائع مثبتة، وتعقد جلساتها بسرية حفاظاً على الخصوصية، مع إمكانية عقدها إلكترونياً عند الحاجة. ويتم تبليغ المعترض بقرار اللجنة خلال ثلاثة أيام كحد أقصى عبر وسائل التبليغ المعتمدة.
وفي حال رفض الاعتراض، يحق للمعترض تصعيد القضية واللجوء إلى ديوان المظالم لاستكمال مسار التقاضي.
The General Directorate of Civil Defense has presented a project that includes proposed rules for organizing the work of appeal committees regarding penalties and sanctions; with the aim of enhancing governance and defining the regulatory procedures related to reviewing objections to violations.
According to the project, the review committees are formed by a decision from the Minister of Interior or his delegate, and must include at least five members who enjoy complete independence from the entities responsible for enforcing violations.
The project allows individuals and establishments to submit their objections officially within 30 days from the date they are notified of the violation decision, and the objection must be registered immediately through the approved channels in the directorate with notification to the applicant. The committee’s secretariat is responsible for reviewing the application within five working days to verify that the requirements are met, and if there are any deficiencies, the objector is granted an additional period of five days to complete them; otherwise, the committee may reject the objection formally.
The rules also require the committee to issue its decision within 15 days of the application being complete, with the possibility of extending this period once for no more than 10 days with written justifications. The objection is considered implicitly rejected if the decision is not issued within the specified period, allowing the objector to resort to the judiciary.
The project emphasizes the principle of transparency, as the objector is allowed to review their file and obtain copies of the documents. They may also consult accredited experts at their own expense to support their position, and committee members are required to disclose in writing any potential conflicts of interest. The objector has the right to request the recusal of any member, including the committee chair, if there is a legitimate reason that affects impartiality.
The rules permit the temporary suspension of the penalty’s execution upon the objector’s request if it is proven that execution may cause them irreparable harm, with the exception of violations related to fraud, deception, or those affecting public health.
The committee’s decisions are issued by majority based on established facts, and its sessions are held in private to maintain confidentiality, with the possibility of holding them electronically when necessary. The objector is notified of the committee’s decision within three days at most through the approved notification methods.
In the event of a rejection of the objection, the objector has the right to escalate the case and resort to the Board of Grievances to continue the litigation process.
