طرحت وزارة الموارد مسودة للضوابط التنظيمية الجديدة لمراكز ضيافة الأطفال الأهلية أكدت فيها ضرورة التزام المراكز بحماية الطفل، والإبلاغ الفوري عند الاشتباه بتعرض أي طفل لأي شكل من أشكال الإيذاء أو الإهمال أو العنف، سواء صدر ذلك من شخص له ولاية أو سلطة على الطفل أو من غيرهم
صنفت المسودة المراكز إلى ثلاثة أنواع، مستقلة، و منزلية، ومراكز داخل مقرات العمل ة تعمل المراكز المستقلة من 6 صباحاً حتى 9 مساءً، فيما تمتد ساعات عمل المراكز المنزلية حتى 10 مساءً وقسّمت المسودة القبول إلى ضيافة مستمرة وضيافة مؤقتة بالساعة أو باليوم، وشددت الضوابط على توفير مساحة لا تقل عن مترين مربعين لكل طفل في منطقة الرعاية، وتركيب كاميرات مراقبة داخلية وخارجية تعمل بشكل مستمر مع حفظ التسجيلات لمدة لا تقل عن 30 يوماً. كما اشترطت أن تكون مديرة المركز ومسؤولات الأطفال سعوديات.
وأتاحت اللائحة المقترحة قبول الأطفال من ذوي الإعاقة البسيطة بشرط تقديم تقرير طبي يثبت قابليتهم للدمج، وتوفير بيئة مجهزة بوسائل الوصول الشامل، إضافة إلى تهيئة العاملين وتزويدهم بالمعرفة اللازمة بأسس التربية الخاصة، واستقطاب كوادر مؤهلة للتعامل مع هذه الفئة،
كما ألزمت الضوابط المراكز بالالتزام بالقيم والمبادئ الإسلامية، وإنشاء سجل خاص بالأطفال الملتحقين، وإبلاغ أولياء الأمور قبل 10 أيام من تعليق العمل.
شددت المسودة على السماح بدخول المصرح لهن فقط من الموظفات والمستفيدات، وتمكين الوزارة وولي الأمر من الاطلاع على التسجيلات عند وجود شكوى، وفيما يتعلق بالمخالفات، نصت الآلية على التدرج الذي يبدأ بإنذار أولي يمنح المركز مهلة 30 يوماً للتصحيح، يليه إنذار نهائي بمهلة 15 يوماً، ثم عقوبات قد تصل إلى إيقاف النشاط لمدة سنة أو سحب الترخيص.
وألزمت الوزارة المراكز القائمة حالياً بتصحيح أوضاعها خلال 180 يوماً من تاريخ نفاذ الضوابط، مع منح حق الاعتراض على العقوبات أمام المحاكم الإدارية خلال 60 يوماً من تاريخ الإبلاغ الرسمي.
The Ministry of Resources has proposed a draft for the new regulatory controls for private child care centers, emphasizing the necessity for these centers to commit to child protection and to report immediately if there is any suspicion that a child is exposed to any form of abuse, neglect, or violence, whether this comes from a person with authority over the child or from others.
The draft categorizes the centers into three types: independent, home-based, and centers within workplaces. Independent centers operate from 6 AM to 9 PM, while home-based centers extend their hours until 10 PM. The draft divides acceptance into continuous care and temporary care by the hour or by the day. The regulations stress the need to provide a space of no less than two square meters for each child in the care area, and to install internal and external surveillance cameras that operate continuously, with recordings kept for no less than 30 days. It also requires that the center director and the child care supervisors be Saudi nationals.
The proposed regulations allow for the acceptance of children with mild disabilities, provided a medical report is submitted proving their suitability for integration, and that an environment equipped with accessible facilities is provided. Additionally, staff must be trained and equipped with the necessary knowledge of special education principles, and qualified personnel should be recruited to deal with this group.
The regulations also require centers to adhere to Islamic values and principles, establish a special record for enrolled children, and inform parents at least 10 days before suspending operations.
The draft emphasizes that only authorized female employees and beneficiaries are permitted entry, and allows the ministry and the guardian to review recordings in the event of a complaint. Regarding violations, the mechanism outlines a graduated approach that starts with an initial warning giving the center a 30-day period to correct the issue, followed by a final warning with a 15-day period, and then penalties that may include suspension of operations for up to a year or revocation of the license.
The ministry has mandated that currently operating centers rectify their situations within 180 days from the date the regulations come into effect, granting the right to appeal against penalties in administrative courts within 60 days from the date of official notification.
