أصدر مجلس إدارة الهيئة العامة للعقار قراراً بالموافقة على «اللائحة التنظيمية للتسويق والإعلانات العقارية»، وذلك استناداً إلى الصلاحيات المخولة له بموجب نظام الوساطة العقارية. وتأتي هذه اللائحة، التي بدأ العمل بها من تاريخ نشرها، كإطار قانوني شامل يضبط ممارسات الإعلان والتسويق العقاري في المملكة عبر الوسائل كافة، بما في ذلك منصات التواصل الاجتماعي، اللوحات الإعلانية، والمنصات الإلكترونية.
ووضعت اللائحة شروطاً دقيقة لا يمكن إصدار ترخيص الإعلان العقاري من دونها، وهي:
• تقديم بيانات دقيقة عن المعلن ووصف العقار.
• تحديد رقم صك تسجيل ملكية العقار (ويستثنى من ذلك العقارات التي تقع تحت إشراف الجهات الحكومية).
• توضيح الحقوق العينية أو الشخصية المراد الإعلان عنها.
• توفير وسيلة تواصل فعالة مع المعلن.
• التزام المعلن بعدم صحة المعلومات المقدمة عند الطلب أو اختلاف المعلومات المضمنة في الترخيص عن المنشورة.
كما أفردت اللائحة تفاصيل دقيقة لمن يرغب في إنشاء منصة عقارية إلكترونية، حيث أوجبت عليهم:
• تسجيل المنصة وربطها تقنياً بالهيئة بعد توثيقها لدى المركز السعودي للمعلومات.
• توثيق حسابات المعلنين عن طريق النفاذ الوطني.
• إضافة بيانات الإعلانات العقارية وفق المعلومات المسترجعة من أنظمة الهيئة التقنية.
• إزالة أي إعلان عقاري فور انتهاء تاريخ صلاحية ترخيصه أو إذا تبين أنه يتضمن معلومات مضللة أو مخالفة للواقع.
• استضافة خادم المنصة (Server) داخل المملكة العربية السعودية.
• إشعار الهيئة قبل التوقف عن ممارسة النشاط بمدة لا تقل عن 10 أيام عمل.
وحذرت اللائحة من ممارسات معينة تُعد مخالفة للنظام، ومنها:
• الإساءة للغير بشكل مباشر أو غير مباشر.
• نشر البيانات الوهمية أو غرض تجميع معلومات المتلقين.
• استخدام مسمى أو شعار أو هوية الهيئة، أو أي جهة حكومية أخرى، دون مسوغ نظامي.
• تضمين الإعلان بيانات تخالف الواقع أو لا تتفق مع طبيعة العقار.
وكذلك نصت اللائحة على ضرورة تضمين الإعلان (باستثناء ما يُنشر في المنصات الإلكترونية المرتبطة تقنياً) البيانات التالية:
• اسم المعلن ورقم ممارسة النشاط.
• وصف العقار وحالته وموقعه، والخدمات والحقوق المرتبطة به.
• توضيح أي نزاعات قائمة بشأن العقار إن وجدت.
• إبراز رقم ترخيص الإعلان وتاريخ انتهاء صلاحيته.
وأكدت اللائحة أن كل من يخالف أحكام هذه اللائحة يعاقب بالعقوبات الواردة في جدول تصنيف المخالفات المقررة في اللائحة التنفيذية لنظام الوساطة العقارية. كما أوضحت المادة الحادية عشرة أن هذه اللائحة تحل محل ضوابط إعلانات العقار السابقة ومعايير ترخيص المنصات الصادرة في عام 1442.
وتهدف الهيئة من خلال هذا التنظيم الموسع إلى ضمان أن تكون كافة المعلومات المقدمة للجمهور دقيقة وشفافة، مما يقلل من النزاعات العقارية ويزيد من جاذبية القطاع للاستثمار المحلي والدولي.
The Board of Directors of the General Authority for Real Estate has issued a decision approving the “Regulatory Framework for Real Estate Marketing and Advertising,” based on the powers granted to it under the Real Estate Brokerage System. This framework, which has been in effect since its publication date, serves as a comprehensive legal framework regulating real estate advertising and marketing practices in the Kingdom through all means, including social media platforms, billboards, and electronic platforms.
The framework has established precise conditions under which a real estate advertising license cannot be issued, which are:
• Providing accurate information about the advertiser and a description of the property.
• Specifying the property ownership registration deed number (properties under the supervision of government entities are exempt from this).
• Clarifying the rights, whether real or personal, intended to be advertised.
• Providing an effective means of communication with the advertiser.
• The advertiser’s commitment to the accuracy of the information provided upon request or the discrepancy between the information included in the license and that published.
The framework also details specific requirements for those wishing to establish an electronic real estate platform, which include:
• Registering the platform and technically linking it to the authority after documenting it with the Saudi Information Center.
• Authenticating the advertisers’ accounts through national access.
• Adding real estate advertisement data according to the information retrieved from the authority’s technical systems.
• Removing any real estate advertisement immediately upon the expiration of its license or if it is found to contain misleading information or is contrary to reality.
• Hosting the platform’s server within the Kingdom of Saudi Arabia.
• Notifying the authority at least 10 working days before ceasing activity.
The framework warns against certain practices considered violations of the system, including:
• Direct or indirect harm to others.
• Publishing false data or collecting information from recipients.
• Using the name, logo, or identity of the authority or any other government entity without legal justification.
• Including information in the advertisement that contradicts reality or does not align with the nature of the property.
The framework also stipulates the necessity of including the following information in the advertisement (except for what is published on technically linked electronic platforms):
• The advertiser’s name and activity practice number.
• A description of the property, its condition and location, and the services and rights associated with it.
• Clarifying any existing disputes regarding the property, if any.
• Highlighting the advertisement license number and its expiration date.
The framework emphasizes that anyone who violates the provisions of this framework will be subject to the penalties outlined in the violation classification table stipulated in the executive regulations of the Real Estate Brokerage System. Article eleven clarifies that this framework replaces the previous real estate advertising controls and the platform licensing standards issued in 1442.
The authority aims, through this expanded regulation, to ensure that all information provided to the public is accurate and transparent, thereby reducing real estate disputes and increasing the attractiveness of the sector for local and international investment.
