دخلت الحكومة الهندية في مواجهة قانونية مع تطبيق تليغرام بعد قرار غير مسبوق بحظر المنصة مؤقتًا، على خلفية اتهامات بفشلها في التعامل مع قنوات زُعم أنها روّجت لتسريبات امتحانات القبول في كليات الطب، وهي القضية التي أثارت جدلًا واسعًا في البلاد خلال الأشهر الأخيرة.
وأظهرت وثائق أن وزارة تكنولوجيا المعلومات الهندية وجهت انتقادات حادة إلى تليغرام بسبب عدم اتخاذ إجراءات استباقية لإزالة حسابات وقنوات تحمل أسماء توحي بامتلاكها نسخًا مسربة من امتحان NEET، وهو الاختبار الوطني الأهم للالتحاق بكليات الطب في الهند.
وجاء قرار الحظر، الذي دخل حيز التنفيذ في 16 يونيو ويستمر حتى 22 يونيو، استنادًا إلى صلاحيات الطوارئ التي استخدمتها حكومة رئيس الوزراء ناريندرا مودي، بعدما تصاعدت المخاوف من استغلال المنصة في عمليات احتيال استهدفت الطلاب الراغبين في دخول الامتحان.
وكانت السلطات الهندية قد ألغت نتائج امتحان NEET في مايو الماضي بعد الاشتباه في تسريب أسئلة الاختبار، ما دفع إلى إعادة تنظيم الامتحان في 21 يونيو وسط ضغوط سياسية وانتقادات واسعة للحكومة.
«تليغرام» تطعن في القرار
من جانبها، تقدمت شركة تليغرام بطعن أمام المحكمة العليا في دلهي، معتبرة أن الحظر ينتهك الحقوق الدستورية للمستخدمين ويمس حرية التعبير.
وأكدت الشركة في مذكراتها القانونية أن القرار يعاقب ملايين المستخدمين الأبرياء بدلًا من معالجة المشكلة الحقيقية، مشيرة إلى أن أي نشاط غير قانوني يمكن أن ينتقل بسهولة إلى منصات أخرى.
ويُعد هذا النزاع أحدث حلقة في سلسلة المواجهات بين الحكومة الهندية وشركات التكنولوجيا العالمية، بعد الخلاف القضائي الذي دار العام الماضي بين نيودلهي ومنصة «إكس» المملوكة للملياردير إيلون ماسك بشأن إزالة المحتوى.
تبادل للاتهامات
وتكشف الوثائق أن الخلاف تصاعد خلال اجتماعات ومراسلات استمرت أسبوعين بين ممثلي الحكومة وإدارة تليغرام.
واتهمت السلطات الهندية المنصة بعدم التحرك ضد قنوات تحمل أسماء مثل «NEET PAPER LEAKED» و«Paper Leaked NEET»، والتي كانت تعرض، مقابل مبالغ مالية، توفير نسخ مزعومة من أسئلة الامتحان.
في المقابل، نفت تليغرام تلك الاتهامات، مؤكدة أنها فوجئت بوصفها بأنها «غير نشطة» في مواجهة المحتوى غير القانوني، وشددت على أن سياساتها تحظر استخدام المنصة في أي أنشطة احتيالية أو مخالفة للقانون.
خلاف حول محاضر الاجتماعات
وكشفت الوثائق أيضًا توترا إضافيا بين الطرفين بسبب محاضر أحد الاجتماعات الرسمية التي عقدت مطلع يونيو، فبحسب السجلات الحكومية، أقر ممثلو تليغرام خلال الاجتماع بوجود صعوبات في الرصد الاستباقي للمحتوى المرتبط بالامتحانات مقارنة بالمحتوى الواضح المخالف مثل مواد الاستغلال الجنسي للأطفال أو المواد الإباحية.
لكن الشركة اعترضت على هذا التوصيف، مؤكدة في رسالة رسمية أن تصريحاتها أُسيء فهمها، وأنها تمتلك بالفعل آليات استباقية لرصد هذا النوع من المحتوى، وإن كانت تتطلب عمليات مراجعة وإشراف بشري أكبر.
وفي دعواها القضائية، وصفت تليغرام محضر الاجتماع الحكومي بأنه «أحادي الجانب وغير دقيق»، متهمة السلطات بتجاهل معلومات قدمتها الشركة بشأن الإجراءات الوقائية التي تطبقها لمكافحة المحتوى المخالف.
أهمية السوق الهندية
وتُعد الهند أكبر أسواق تليغرام عالميًا، إذ تضم نحو 150 مليون مستخدم. وتستمد المنصة شعبيتها من قدرتها على استضافة مجموعات يصل عدد أعضائها إلى 200 ألف شخص، إضافة إلى إمكانية التواصل دون إظهار أرقام الهواتف.
غير أن هذه المزايا نفسها جعلت التطبيق عرضة لانتقادات متكررة تتعلق باستخدامه في أنشطة احتيالية أو غير قانونية، وهي اتهامات تنفيها الشركة باستمرار، مؤكدة أنها تتخذ إجراءات سريعة ضد الحسابات المخالفة.
ومع استمرار المعركة القضائية، يترقب المستخدمون والشركات التقنية في الهند قرار المحكمة بشأن مستقبل الحظر، في قضية قد تشكل سابقة جديدة في العلاقة المتوترة بين الحكومات ومنصات التواصل الرقمية.
The Indian government has entered into a legal confrontation with the Telegram app following an unprecedented decision to temporarily ban the platform, amid accusations of its failure to address channels that allegedly promoted leaks of medical college entrance exam papers, a case that has sparked widespread controversy in the country over the past few months.
Documents have shown that the Indian Ministry of Information Technology sharply criticized Telegram for not taking proactive measures to remove accounts and channels bearing names suggesting they possessed leaked copies of the NEET exam, the most important national test for admission to medical colleges in India.
The ban, which came into effect on June 16 and will last until June 22, was based on emergency powers used by Prime Minister Narendra Modi’s government, after concerns grew about the platform being exploited in fraud schemes targeting students wishing to take the exam.
Indian authorities had canceled the NEET exam results in May after suspicions arose regarding the leakage of exam questions, prompting a reorganization of the exam on June 21 amid political pressure and widespread criticism of the government.
“Telegram” challenges the decision
For its part, Telegram has filed an appeal with the Delhi High Court, arguing that the ban violates users’ constitutional rights and infringes on freedom of expression.
The company asserted in its legal briefs that the decision punishes millions of innocent users instead of addressing the real problem, noting that any illegal activity can easily shift to other platforms.
This dispute is the latest episode in a series of confrontations between the Indian government and global tech companies, following the legal dispute last year between New Delhi and the “X” platform owned by billionaire Elon Musk regarding content removal.
Exchange of accusations
The documents reveal that the dispute escalated during two weeks of meetings and correspondence between government representatives and Telegram’s management.
The Indian authorities accused the platform of failing to act against channels with names like “NEET PAPER LEAKED” and “Paper Leaked NEET,” which were offering, for a fee, alleged copies of exam questions.
In response, Telegram denied these accusations, asserting that it was surprised to be described as “inactive” in addressing illegal content, emphasizing that its policies prohibit the use of the platform for any fraudulent or illegal activities.
Dispute over meeting minutes
The documents also revealed additional tension between the two parties due to the minutes of an official meeting held in early June. According to government records, Telegram representatives acknowledged during the meeting that there were difficulties in proactively monitoring content related to exams compared to clearly illegal content such as child sexual exploitation materials or pornography.
However, the company objected to this characterization, confirming in an official letter that its statements were misunderstood and that it indeed has proactive mechanisms for monitoring this type of content, although they require greater review and human oversight.
In its lawsuit, Telegram described the government meeting minutes as “one-sided and inaccurate,” accusing the authorities of ignoring information provided by the company regarding the preventive measures it implements to combat illegal content.
Importance of the Indian market
India is Telegram’s largest market globally, with around 150 million users. The platform derives its popularity from its ability to host groups of up to 200,000 members, in addition to allowing communication without revealing phone numbers.
However, these very advantages have made the app subject to repeated criticisms regarding its use in fraudulent or illegal activities, accusations that the company consistently denies, asserting that it takes swift action against violating accounts.
As the legal battle continues, users and tech companies in India are awaiting the court’s decision regarding the future of the ban, in a case that could set a new precedent in the strained relationship between governments and digital communication platforms.
