لم تكن بائعة الشاي هدير محمد شعبان تعلم أن يوم عملها المعتاد في منطقة حدائق الأهرام سيكون الأخير، بعدما تحولت لحظات قليلة إلى مأساة هزت الشارع المصري، إثر تعرضها للدهس بسيارة يقودها طالب قاصر، في حادثة وثقتها كاميرات المراقبة وأثارت موجة واسعة من الغضب والتعاطف.
ومع تصاعد ردود الفعل حول الواقعة، أصدرت النيابة العامة المصرية قرارات عاجلة بحق المتهمين، في إطار التحقيقات الجارية لكشف ملابسات الحادثة وتحديد المسؤوليات القانونية.
حبس المتهمين
وقررت نيابة الطفل، بإشراف المحامي العام الأول لنيابات شمال الجيزة الكلية المستشار أمير فتحي، حبس الطالب مروان (15 عاماً)، ووالده مالك السيارة، والفتاة جودي (16 عاماً)، لمدة 4 أيام على ذمة التحقيقات، مع مراعاة التجديد في المواعيد القانونية.
كما صرحت النيابة بدفن جثمان هدير محمد شعبان عقب استكمال الإجراءات القانونية، وأمرت بعرض المصابة رحاب عبد المقصود عبد الحافظ على أحد المستشفيات الحكومية لإجراء الفحوص الطبية اللازمة وإعداد تقرير مفصل عن حالتها الصحية.
تفاصيل التحقيقات
وكلفت النيابة بإجراء معاينة تفصيلية لموقع الحادثة، شملت فحص الطريق وتحديد اتجاهات السير، وحالة الإضاءة والرؤية وقت وقوع الواقعة، إلى جانب بيان وجود آثار للمكابح من عدمه وطولها حال العثور عليها.
كما أمرت بتفريغ كاميرات المراقبة المحيطة بمسرح الحادثة، وإعداد تقرير بالإجراءات التي تم اتخاذها، إضافة إلى ندب مهندس فني لفحص السيارة المضبوطة وبيان حالتها الفنية وملابسات التلفيات الموجودة بها.
وشملت القرارات إخطار خط نجدة الطفل بالواقعة، في إطار استكمال التحقيقات المرتبطة باستخدام قاصر للسيارة وظروف وقوع الحادثة.
رواية النيابة
وقالت النيابة العامة، في بيان رسمي، إنها تلقت إخطاراً بوقوع حادثة تصادم بمنطقة حدائق الأهرام أسفرت عن وفاة سيدة وإصابة أخرى أثناء وجودهما بمحل عملهما بعربة لبيع المشروبات.
وأضافت أنها انتقلت إلى موقع الحادثة، وأجرت المعاينة اللازمة، وفحصت كاميرات المراقبة، واستمعت إلى أقوال المصابة و5 من شهود الواقعة.
وكشفت التحقيقات الأولية، بحسب البيان، أن الشهود أكدوا أن الفتاة جودي كانت تقود السيارة وقت وقوع الحادثة، فيما أقر الطالب المتهم خلال التحقيقات بوقائع مرتبطة بالحادثة.
وأوضحت النيابة أن والد الطالب مكنه من استخدام السيارة رغم علمه بعدم امتلاكه رخصة قيادة، وهو ما ترتب عليه وقوع الحادثة.
اتهامات قانونية
ووجهت النيابة إلى المتهمين اتهامات بالتسبب في وفاة المجني عليها وإصابة أخرى، وإتلاف السيارة، إضافة إلى قيادة مركبة آلية دون ترخيص.
كما وجهت إلى الطالب ووالده اتهامات تتعلق بتمكين شخص من قيادة مركبة دون ترخيص، فيما وُجه إلى الأب اتهام بتعريض طفل للخطر.
وكانت وزارة الداخلية المصرية قد أعلنت تلقي الأجهزة الأمنية بلاغاً بوقوع حادثة تصادم بدائرة قسم شرطة الأهرام، وتبين أن السيارة كان يقودها طالب يبلغ من العمر 15 عاماً لا يحمل رخصة قيادة، وبرفقته فتاة، قبل أن تنحرف المركبة وتصطدم بالسيدة أثناء وجودها بالقرب من مكان عملها.
غضب على مواقع التواصل
وأثار مقطع الفيديو المتداول للحادثة موجة من الاستياء على مواقع التواصل الاجتماعي، وسط مطالبات بتشديد الرقابة على ظاهرة قيادة القاصرين للسيارات، ومحاسبة أولياء الأمور الذين يسمحون لأبنائهم باستخدام المركبات بالمخالفة للقانون.
وينص قانون المرور المصري على معاقبة قيادة سيارة دون الحصول على رخصة بالحبس مدة لا تتجاوز 6 أشهر أو غرامة مالية، فيما تعاقب المادة 238 من قانون العقوبات على التسبب بالخطأ في وفاة شخص، مع تشديد العقوبة حال وجود ظروف مشددة أو ارتكاب خطأ جسيم أدى إلى الوفاة.

As reactions to the incident escalated, the Egyptian Public Prosecution issued urgent decisions against the accused, as part of the ongoing investigations to uncover the circumstances of the incident and determine legal responsibilities.
Detention of the Accused
The Child Prosecution, under the supervision of the Chief Public Prosecutor of North Giza, Counselor Amir Fathi, decided to detain the student Marwan (15 years old), his father, the owner of the car, and the girl Judy (16 years old), for 4 days pending investigations, with consideration for renewal within legal deadlines.
The prosecution also authorized the burial of Hadeer Mohamed Shaaban’s body after completing the legal procedures and ordered that the injured Rehab Abdel-Maqsoud Abdel-Hafez be taken to a government hospital for necessary medical examinations and to prepare a detailed report on her health condition.
Investigation Details
The prosecution tasked investigators with conducting a detailed examination of the accident site, which included inspecting the road, determining traffic directions, and assessing the lighting and visibility conditions at the time of the incident, as well as checking for brake marks and their length if found.
They also ordered the review of surveillance cameras surrounding the accident scene and the preparation of a report on the actions taken, in addition to appointing a technical engineer to inspect the seized vehicle and assess its technical condition and the circumstances of the damages present.
The decisions included notifying the Child Helpline about the incident, as part of the ongoing investigations related to the use of a vehicle by a minor and the circumstances of the accident.
Prosecution’s Account
The Public Prosecution stated in an official statement that it received a notification of a collision incident in the Al-Haram Gardens area that resulted in the death of a woman and the injury of another while they were at their workplace in a beverage-selling cart.
It added that it moved to the accident site, conducted the necessary examination, reviewed surveillance footage, and listened to the statements of the injured party and five witnesses to the incident.
Initial investigations revealed, according to the statement, that witnesses confirmed that the girl Judy was driving the car at the time of the incident, while the accused student admitted during investigations to facts related to the accident.
The prosecution clarified that the student’s father allowed him to use the car despite knowing that he did not possess a driving license, which led to the occurrence of the accident.
Legal Charges
The prosecution charged the accused with causing the death of the victim and injuring another, damaging the vehicle, and driving a motor vehicle without a license.
Additionally, charges were brought against the student and his father related to allowing a person to drive a vehicle without a license, while the father was charged with endangering a child.
The Egyptian Ministry of Interior had announced that security forces received a report of a collision incident within the jurisdiction of the Al-Haram Police Station, revealing that the car was driven by a 15-year-old student without a driving license, accompanied by a girl, before the vehicle veered off and struck the woman while she was near her workplace.
Outrage on Social Media
The circulated video clip of the incident sparked a wave of outrage on social media, with calls for stricter oversight on the phenomenon of minors driving cars and holding parents accountable for allowing their children to use vehicles in violation of the law.
The Egyptian traffic law stipulates that driving a car without a license is punishable by imprisonment for a period not exceeding 6 months or a fine, while Article 238 of the Penal Code punishes causing the accidental death of a person, with the penalty being aggravated in the presence of aggravating circumstances or committing a gross error that led to death.
