The Albanian government has approved new legislative measures imposing fines of up to approximately $6,130 on individuals participating in gatherings that turn into acts of violence or looting, even if they themselves do not commit violent acts, in a move aimed at tightening restrictions on protests demanding the resignation of Prime Minister Edi Rama.

The capital, Tirana, has witnessed anti-government protests for months, which have intensified in recent days, turning into confrontations between security forces and demonstrators, amid growing public anger over corruption allegations, public service issues, and declining opportunities for youth.

Heavy fines and measures to restrict gatherings

Rama’s government has adopted legislative measures stipulating fines of up to 500,000 Albanian lek, equivalent to about 5,500 euros or $6,130, on “anyone who chooses to remain within a crowd” engaging in acts of violence or looting in a public place, or who deliberately conceals their identity.

The amount of the fine is of particular interest given the significant disparity between it and the average wage in the country; the average monthly salary in Albania before tax deductions is about 930 euros, meaning that the maximum fine is nearly six times the average monthly salary.

The new measures grant police the authority to temporarily restrict gatherings in specific areas, including around educational, health, and government institutions, if there is a risk of violence erupting.

The measures also include penalties for incitement to violence online, as well as provisions for compensations for small businesses that suffer damages during protests.

The measures took effect immediately upon adoption, but they require parliamentary approval within 45 days to remain in force.

Protests that began over a hotel project expanded to corruption issues

The protest movement began peacefully last May, without a clear central leadership, organizing gatherings in opposition to a project to build a luxury hotel within a nature reserve, which is supported by Jared Kushner, son-in-law of U.S. President Donald Trump.

However, the protests took a broader turn in mid-October when student-led movements escalated to include demands for fighting corruption, improving the healthcare system, and providing better economic and social prospects for the youth in the country, which has a population of about 2.3 million.

As the demands expanded, the protests turned into an anti-government movement, and the intensity of confrontations in the capital increased in recent days, coinciding with calls for Rama’s resignation.

Rama draws inspiration from a French experience and speaks of foreign interventions

For his part, Prime Minister Edi Rama stated that he drew inspiration for the new measures from a French bill approved by the French Senate, aimed at holding protesters financially responsible for the damages they cause during street protests.

At the same time, Rama accused foreign parties of being behind the acts of violence, referring to what he described as foreign interventions in fueling the unrest.

He also accused Russia and Iran of spreading misleading information online, without the text providing details or independent evidence to support these accusations.

Despite emphasizing the need to confront acts of violence, the Prime Minister has repeatedly called for dialogue, at a time when his government faces increasing pressure due to the protests and allegations related to corruption and public service performance.

Debate over the limits of protest and collective responsibility

The new measures open a discussion about the limits of responsibility for participants in public gatherings, especially since the fines could affect individuals who remain within a crowd witnessing acts of violence, even if they are not proven to have personally committed violent acts, according to the wording in the decision.

Moreover, the powers to restrict gatherings around public institutions and the penalties related to content published online may raise questions about the balance between maintaining public security and ensuring the right to protest and express oneself.

As the measures come into effect, attention turns to the Albanian parliament, which must decide on them within 45 days, and to the potential impact of these measures on the ongoing protests in Tirana, as protesters remain steadfast in their demands related to fighting corruption and improving living conditions and public services.
