In a humanitarian and legal case that drew attention to the rights of parents to see their children, the Al Ain Court of Civil, Commercial, and Administrative Claims in the United Arab Emirates issued a ruling obligating the children’s grandmother to pay their father an amount of 5,000 dirhams as compensation for the psychological and moral damages he suffered.
This ruling came after a journey of suffering that lasted for more than eight months, during which the father was arbitrarily deprived of seeing his children due to the grandmother’s refusal to hand them over to him. This prompted the father to resort to the court and file a lawsuit demanding financial compensation of 50,000 dirhams.
The legal dispute took a decisive turn after the grandmother was found guilty in a criminal case for the charge of refusing to hand over the ward. The court clarified in the reasoning of its ruling that the final criminal judgment definitively established the occurrence of the error and attributed it to the accused, which was the common basis upon which the civil lawsuit was built.
Based on this, the court confirmed the presence of the elements of civil liability, including a proven error by a judicial ruling, and psychological and moral damage suffered by the father as a result of being deprived of his children, along with a clear causal relationship between them, which necessitated compensation. The court concluded by obligating the grandmother to pay the financial compensation amounting to 5,000 dirhams along with fees and expenses.
