بعدمرورنحو 3 أشهر على الانتخابات البرلمانية، فإن المشهد السياسي العراقي لايزال عالقاً، في ظل عدم تمكن مجلس النواب من استكمال الاستحقاقات الدستورية، إذ تحول الخلافات الكردية حتى الآن دون انتخاب رئيس الجمهورية، ما يفاقم أزمة تشكيل الحكومة.
ومع الانسداد السياسي الحاصل، فإن أزمة اختيار رئيس الجمهورية تنعكس بشكل مباشر على بقية الاستحقاقات الدستورية، إذ لا يمكن تكليف رئيس للوزراء من دون انتخاب رئيس الدولة.
وحذر مراقبون من أن استمرار الخلافات قد يقود العراق إلى فراغ دستوري وشلل كامل في النظام السياسي.
وتأتي هذه الأزمة في ظل هشاشة المشهد السياسي وتصاعد الضغوط الإقليمية والدولية، التي انعكست على قدرة القوى السياسية على التوصل إلى تسويات وتوافقات داخلية، خصوصاً بين الحزبين الكرديين الديمقراطي الكردستاني والاتحاد الوطني، والإطار التنسيقي الذي يجمع القوى السياسية الحاكمة في البلاد.
وأعلن مجلس النواب العراقي، مساء الجمعة، جدول أعمال جلسته المقررة غداً الإثنين، الذي لم يتضمن أي فقرة تتعلق بانتخاب رئيس الجمهورية، ما يشير إلى استمرار عدم التوصل إلى توافق سياسي حول هذا الملف الحساس، ويزيد من حدة حالة الفراغ الدستوري.
وفي هذا السياق، اعتبر تقرير حقوقي أن العراق دخل عملياً في مرحلة الفراغ الدستوري، لكن بموجب الدستور لا توجد إجراءات عقابية أو عقوبات على تجاوز المدد الدستورية، إلا أن البلاد تدخل في مرحلة صعبة في ظل تأثيرات سياسية واقتصادية واضحة.
ولفت التقرير إلى أن الحكومة الحالية تعمل بصلاحيات تصريف الأعمال، وبالتالي لا يمكن لها اتخاذ قرارات جديدة، وأي قرارات حكومية تصدر ستكون عرضة للإلغاء، كما أن الوزراء لا يملكون حق توقيع أو إصدار كتب تحتوي على قرارات جديدة.
وتحدث التقرير عن فشل الكتل السياسية في انتخاب رئيس الجمهورية، وبالتالي تعيين رئيس مجلس الوزراء، يجب أن يواجهه مجموعة من النواب بإجراءات للحد من هذا الفراغ الدستوري، أما إذا خضعوا لرؤساء كتلهم السياسية وادخلوا البلاد بتأثيرات سياسية واقتصادية فهذا يعد من باب الحنث باليمين، ويترتب عليه إجراءات عقابية محتملة.
ووفق التقرير، فإن التدخلات الخارجية هي التي جعلت المشهد السياسي هشاً، كما تبين من تغريدة للرئيس الأمريكي دونالد ترمب، التي قلبت الموازين على جميع الأطراف السياسية، في إشارة إلى إعلان رفضه لترشيح زعيم ائتلاف دولة القانون نوري المالكي لرئاسة الوزراء.
وحذّر التقرير من أن أحد النتائج المتوقعة للانقسام السياسي الحالي قد تكون عودة نشاط داعش، خصوصاً مع نقل آلاف السجناء من سورية إلى العراق.
After nearly 3 months since the parliamentary elections, the Iraqi political scene remains stuck, as the House of Representatives has not been able to complete the constitutional entitlements. The ongoing Kurdish disagreements have so far prevented the election of the President of the Republic, exacerbating the crisis of government formation.
With the current political stalemate, the crisis of choosing a President directly affects the other constitutional entitlements, as it is impossible to assign a Prime Minister without electing the head of state.
Observers have warned that the continuation of disagreements could lead Iraq to a constitutional vacuum and a complete paralysis of the political system.
This crisis comes amid the fragility of the political scene and the rising regional and international pressures, which have reflected on the ability of political forces to reach internal settlements and agreements, especially between the two Kurdish parties, the Kurdistan Democratic Party and the Patriotic Union, and the Coordination Framework that brings together the ruling political forces in the country.
The Iraqi House of Representatives announced on Friday evening the agenda for its session scheduled for tomorrow, Monday, which did not include any item related to the election of the President of the Republic, indicating the continued failure to reach a political consensus on this sensitive issue, further intensifying the state of constitutional vacuum.
In this context, a human rights report considered that Iraq has practically entered a phase of constitutional vacuum, but according to the constitution, there are no punitive measures or penalties for exceeding constitutional deadlines. However, the country is entering a difficult phase amid clear political and economic impacts.
The report pointed out that the current government operates with limited powers, and thus cannot make new decisions. Any governmental decisions issued will be subject to cancellation, and ministers do not have the right to sign or issue documents containing new decisions.
The report discussed the failure of political blocs to elect a President of the Republic, and consequently appoint a Prime Minister, which should be confronted by a group of deputies with measures to limit this constitutional vacuum. If they submit to their political bloc leaders and lead the country into political and economic impacts, this would be considered a breach of oath, which could result in potential punitive measures.
According to the report, external interventions have made the political scene fragile, as evidenced by a tweet from U.S. President Donald Trump, which shifted the balance among all political parties, referring to his announcement rejecting the nomination of the leader of the State of Law Coalition, Nouri al-Maliki, for the premiership.
The report warned that one of the expected outcomes of the current political division could be the resurgence of ISIS, especially with the transfer of thousands of prisoners from Syria to Iraq.
