The Ministry of Environment, Water, and Agriculture has approved a package of measures and penalties related to violations of the regulations for preparing, approving, and implementing environmental rehabilitation plans, with fines reaching up to 3 million riyals according to the executive regulations approved by the minister.
The regulations included the competencies of the ministry and national centers for the environmental sector, as well as the General Authority for the Conservation of Coral Reefs and Turtles in the Red Sea. Among the key responsibilities are preparing the requirements, conditions, and technical regulations related to environmental rehabilitation plans and their implementation, monitoring environmentally degraded sites or those that have suffered damage or pollution, and identifying the causes of degradation and the parties responsible for it.
The competencies also included creating a register of environmental media that require rehabilitation and updating it, ensuring it includes the site’s condition, priority, stage of plan preparation or implementation, and results of verification of its completion.
The regulations clarified that if the damage, pollution, or environmental degradation is caused by an establishment or activity with an environmental impact, the National Center for Environmental Compliance Monitoring is responsible for receiving the rehabilitation plan, coordinating its review, notifying the submitter of any completion requests, issuing a decision to approve it, and following up on its implementation, without prejudice to the competencies of other relevant authorities concerning the affected environmental media.
The center is also responsible for determining the requirements related to the source of the damage or pollution, verifying the establishment’s compliance with the environmental permit and conditions and regulations, identifying the requirements for stopping and containing pollution and addressing it, and following up on the implementation of the procedures and verifying their completion.
Rehabilitation Plan
The regulations require the individual, upon learning of an incident or violation related to the implementation of the rehabilitation plan that results in or is likely to result in pollution or environmental damage, to notify the competent authority and take immediate necessary measures to contain the damage and limit its spread or exacerbation.
It stipulated that the violator must correct the violation and repair the damage and pay compensations, granting them a grace period for correction before imposing the penalty if they voluntarily disclose the violation or report it themselves.
Regarding fines, the regulations specified that the fines for minor violations by individuals are set at 25% of the prescribed fines, while fines for serious violations are estimated based on the degree of damage, the environmental importance of the affected site, its area, and the resulting economic and social impacts. When estimating fines for minor violations, the size of the activity, its economic classification, and the nature of the surrounding area are taken into account.
The competent authority for minor violations is authorized to issue more than one warning, extend the grace period, or postpone the imposition of the fine if correction requires additional time, provided there are acceptable technical justifications and the violator continues to take corrective actions.
The regulations consider serious violations to include providing incorrect or misleading data or information, or concealing essential information that affects the approval of the plan or the follow-up on its implementation or verification of its completion, as well as failing to take immediate measures to contain pollution or damage if this leads to its continuation, spread, or exacerbation.
Failure to Report.. Violation
Violations include failing to report incidents immediately upon knowledge if this leads to the spread or exacerbation of damage, or obstructing immediate measures, and failing to notify the competent authority before starting to implement the plan within the timeframe specified in the approval decision, or commencing implementation before the issuance of the approval decision.
The ministry has set a fine of up to 3 million riyals within the third category for the violation of failing to take the necessary immediate measures to contain pollution or damage and limit its spread or exacerbation, if this results in the continuation or spread of damage, as well as refraining from starting the implementation of the approved rehabilitation plan or completely stopping its implementation without the approval of the competent authority, after warning the violator and the expiration of the specified grace period without starting or resuming implementation.
