The dispute in Malaysia has escalated between the royal palace and the Attorney General’s office, following the implementation of a royal decree allowing imprisoned former Prime Minister Najib Abdul Razak to serve the remainder of his sentence under house arrest, amidst a rare legal confrontation that has raised accusations of defying royal orders, while the government insists on the necessity of adhering to judicial procedures.
The Malaysian Attorney General defended his decision on Saturday to seek legal clarifications regarding the royal decree, rejecting accusations of treason or insulting the king, after the palace issued a strongly worded statement affirming that the royal pardon issued by Sultan Ibrahim Iskandar is clear and must be executed, and that all required conditions for its implementation have been met.
The Attorney General’s office had temporarily halted, on Friday, the procedures for transferring Najib Abdul Razak from prison to house arrest, considering that the matter requires further legal clarification before implementation.
The royal palace responded on Saturday by affirming that the king’s powers to pardon Abdul Razak, which allow him to serve the remainder of his sentence under house arrest, are unequivocal, emphasizing the necessity of respecting the royal decree, and warning that any attempt to challenge or obstruct it represents a defiance of the king’s decision.
Najib Abdul Razak’s Return to Prison Hours After His Release
The former Malaysian Prime Minister had left prison on Friday after his political party paid a financial penalty of 50 million ringgit, equivalent to about 12.3 million dollars, which was a condition for implementing the house arrest order.
However, Abdul Razak returned to prison just a few hours later, following the Attorney General’s intervention and the suspension of the transfer procedures, opening the door to a public confrontation between the royal institution and the highest legal authority in the government.
The Attorney General’s office clarified that the request for judicial clarification does not aim to contest or challenge the royal pardon, but rather relates to determining the legal effect of the release order issued by the Supreme Court on Friday, following the payment of the fine.
The fundamental issue, according to the office, is to ascertain whether the release order means that Abdul Razak has indeed completed his initial sentence, or whether part of the sentence still needs to be served, which would determine the start date for the execution of his second sentence.
The office confirmed that obtaining a judicial interpretation is necessary to ensure the implementation of the royal decree and existing judicial rulings in accordance with the law, describing the accusations of insulting the king or treason as baseless.
It stated in a statement that “the pursuit of legal certainty through the courts is a responsible step to maintain the integrity of the administration of justice.”
Two Sentences in the 1MDB Corruption Case
Najib Abdul Razak has been serving a prison sentence since August 2022, after Malaysia’s highest court upheld his conviction in his first trial related to corruption, linked to the scandal of embezzling billions of dollars from the government investment fund “1MDB.”
Last September, the King of Malaysia granted Razak a pardon that reduced his initial sentence to six years, allowing him to serve the remaining time under house arrest, provided he pays the financial penalty imposed by the court.
However, this decision does not include a separate 15-year prison sentence issued against the former Prime Minister in December 2025, related to corruption and money laundering charges in a second major trial linked to the same fund scandal.
Abdul Razak is currently appealing the second prison sentence, making the legal dispute regarding the end of his first sentence and the start of the second a pivotal issue in determining his legal status.
A Rare Confrontation Between the Palace and Legal Authorities
This public clash between the royal palace and the Attorney General’s office is an unusual development in Malaysia, which operates under a constitutional monarchy where the king serves as the head of state, while the elected government manages the country’s affairs, and the courts are responsible for interpreting laws and resolving legal disputes.
The dispute places Malaysian authorities in a delicate position to balance the king’s constitutional powers with the necessity of executing judicial rulings within legal frameworks, especially since the case involves a prominent political figure convicted in one of the largest financial corruption scandals in the country’s history.
