قدم المركز الوطني للتفتيش والرقابة مشروعاً تنظيمياً جديداً عبر منصة «استطلاع»، يهدف إلى حوكمة إجراءات الاعتراض على المخالفات في كافة الجهات الحكومية، واضعاً معايير دقيقة لتشكيل اللجان وآليات عملها لضمان حماية حقوق الأفراد والمنشآت، وتوحيد المسارات النظامية بدءاً من تقديم الطلب وحتى صدور القرار النهائي وتنفيذه.
ومنحت القواعد التنظيمية المقترحة المتظلمين مهلة 60 يوماً لتقديم اعتراضاتهم عبر «المنصة الوطنية للتفتيش والرقابة»، من تاريخ التبليغ بالمخالفة، ملزمة اللجان بالبت في الطلبات خلال 15 يوماً فقط من اكتمال البيانات، مع إمكانية التمديد لمرة واحدة لمدة 10 أيام عند الضرورة.
لجان نظر مستقلة
ووفق المقترح، ألزمت القواعد التنظيمية المقترحة الجهات الحكومية بتشكيل لجان نظر مستقلة بقرار من الوزير المختص، تتألف من ثلاثة أعضاء كحد أدنى، مشترطة وجود عضو قانوني، وعضو فني متخصص في النشاط، وعضو مستقل، لضمان الكفاءة والمهنية في دراسة الملفات.
وأكد المشروع مبدأ «الحياد التام»، ومنع أن يكون رئيس اللجنة أو نائبه تابعين إدارياً للجهة التي باشرت ضبط المخالفة، مع إتاحة الحق للمعترض في طلب رد أي عضو في حال وجود تعارض مصالح أو سبب يخل بالنزاهة.
وأكد المقترح، أن عدم صدور قرار من اللجنة خلال المدة النظامية المحددة يُعتبر «رفضاً ضمنياً» للاعتراض، مما يفتح المجال مباشرة للمتظلم للتوجه إلى القضاء الإداري لحفظ حقوقه دون انتظار لا طائل منه.
تنفيذ العقوبة مؤقتاً
وأتاحت القواعد للجنة صلاحية تعليق تنفيذ العقوبة مؤقتاً إذا ثبت أن تنفيذها سيلحق بالمعترض ضرراً جسيماً لا يمكن تداركه، بشرط ألا تكون المخالفة مرتبطة بحالات الغش أو التأثير المباشر على الصحة العامة.
وبين المقترح العزم على الاعتماد الكامل على القنوات الرقمية، واعتبرت التبليغ عبر المنصة الإلكترونية أو الوسائل الرسمية منتجاً لآثاره النظامية فور إرساله، مما ينهي عهد التبليغات الورقية والاجتهادات الفردية في إيصال القرارات.
وأكد المشروع سرية الجلسات والمداولات، مع إلزام الأعضاء بالإفصاح الكتابي عن أي مصالح قد تؤثر على حيادهم، وفرض مساءلة إدارية مشددة على أي عضو يخل بواجباته، لضمان أعلى درجات النزاهة في العمل الرقابي.
ووفق المقترح، أجاز التنظيم للجان الاستعانة بخبراء فنيين من خارج الجهة لتقديم الرأي في القضايا المعقدة، مع تحميل الجهة للتكاليف، إلا في حال كان الخبير بطلب من المعترض، فتكون التكاليف على نفقته الخاصة وفق ضوابط محددة.
The National Center for Inspection and Control has presented a new regulatory project through the “Survey” platform, aimed at governing the procedures for objections to violations across all government entities. It establishes precise criteria for forming committees and their operational mechanisms to ensure the protection of the rights of individuals and establishments, and to unify the regulatory pathways starting from the submission of the request until the issuance of the final decision and its implementation.
The proposed regulatory rules grant complainants a period of 60 days to submit their objections via the “National Platform for Inspection and Control,” starting from the date of notification of the violation. The committees are required to decide on the requests within just 15 days from the completion of the data, with the possibility of a one-time extension for 10 days if necessary.
Independent Review Committees
According to the proposal, the suggested regulatory rules obligate government entities to form independent review committees by a decision from the relevant minister, consisting of at least three members, requiring the presence of a legal member, a technical expert in the activity, and an independent member, to ensure efficiency and professionalism in reviewing the files.
The project emphasizes the principle of “complete neutrality,” preventing the chairperson or deputy of the committee from being administratively affiliated with the entity that initiated the violation control, while allowing the complainant the right to request the recusal of any member in case of a conflict of interest or any reason that undermines integrity.
The proposal states that if the committee does not issue a decision within the specified regulatory period, it is considered a “tacit rejection” of the objection, which directly allows the complainant to approach the administrative judiciary to safeguard their rights without unnecessary waiting.
Temporary Suspension of Penalty Execution
The rules allow the committee the authority to temporarily suspend the execution of the penalty if it is proven that its execution would cause the complainant serious harm that cannot be remedied, provided that the violation is not related to cases of fraud or direct impact on public health.
The proposal indicates an intention to rely entirely on digital channels, considering notification via the electronic platform or official means as producing its regulatory effects immediately upon sending, thus ending the era of paper notifications and individual efforts in delivering decisions.
The project ensures the confidentiality of sessions and deliberations, requiring members to disclose in writing any interests that may affect their neutrality, and imposing strict administrative accountability on any member who fails in their duties, to ensure the highest levels of integrity in oversight work.
According to the proposal, the regulation allows committees to seek technical experts from outside the entity to provide opinions on complex cases, with the entity bearing the costs, unless the expert is requested by the complainant, in which case the costs will be borne by the complainant according to specific regulations.
