أدان البرلمان العربي بأشد العبارات مصادقة كنيست الاحتلال الإسرائيلي على مشروع قانون يوسع آليات الاستيلاء على أموال المقاصة الفلسطينية، معتبراً أن هذه الخطوة تمثل «جريمة قرصنة مالية منظمة» وانتهاكاً صارخاً للقانون الدولي والاتفاقيات الموقعة بين الجانبين.
وأكد رئيس البرلمان العربي محمد بن أحمد اليماحي، في بيان رسمي، أن مواصلة الاحتلال احتجاز الأموال الفلسطينية المستحقة قانوناً يعد اعتداءً مباشراً على الحقوق الاقتصادية للشعب الفلسطيني، ومحاولة متعمدة لخنق الاقتصاد الفلسطيني وإضعاف مؤسسات السلطة الوطنية الفلسطينية وتقويض قدرتها على الوفاء بالتزاماتها الأساسية تجاه المواطنين.
وأوضح أن السياسات الإسرائيلية تأتي ضمن مخطط متكامل يستهدف تدمير مقومات الحياة الفلسطينية، بالتوازي مع الحرب الدائرة في قطاع غزة، وتصاعد الاستيطان ومصادرة الأراضي وعمليات التهجير القسري واعتداءات المستوطنين في الضفة الغربية والقدس المحتلة، بهدف فرض واقع جديد على الأرض وتقويض الحقوق الوطنية المشروعة للشعب الفلسطيني.
وشدد رئيس البرلمان العربي على أن إقرار الكنيست الإسرائيلي تشريعات تتيح الاستيلاء على الأموال الفلسطينية لا يمنح هذه الممارسات أي شرعية قانونية، بل يكشف استمرار سياسة الإفلات من العقاب التي يتمتع بها الاحتلال نتيجة عجز المجتمع الدولي عن اتخاذ إجراءات حاسمة لوقف انتهاكاته المتكررة.
ودعا اليماحي المجتمع الدولي ومجلس الأمن والبرلمانات الإقليمية والدولية إلى تحمل مسؤولياتهم القانونية والأخلاقية، والتحرك العاجل للضغط على الاحتلال من أجل الإفراج الفوري وغير المشروط عن جميع أموال المقاصة الفلسطينية المحتجزة، ومحاسبته على انتهاكاته للقانون الدولي وقرارات الشرعية الدولية.
كما طالب بالعمل على تجميد مشاركة الكنيست الإسرائيلي في المحافل البرلمانية الدولية، معتبراً أنه يوفر الغطاء التشريعي لسياسات الاحتلال وممارساته الاستيطانية والعنصرية بحق الشعب الفلسطيني.
تُعد أموال المقاصة إيرادات ضريبية وجمركية تجبيها إسرائيل نيابة عن السلطة الفلسطينية على السلع الواردة إلى الأراضي الفلسطينية، بموجب الترتيبات الاقتصادية المنبثقة عن اتفاقية أوسلو، ثم تقوم بتحويلها شهرياً إلى السلطة الفلسطينية.
وتشكل هذه الأموال المصدر الرئيسي لإيرادات الموازنة الفلسطينية، إذ تمثل نسبة كبيرة من دخل السلطة، ما يجعل أي اقتطاع أو تجميد لها ينعكس مباشرة على قدرة الحكومة الفلسطينية على دفع رواتب الموظفين وتوفير الخدمات الأساسية.
وخلال السنوات الأخيرة، لجأت الحكومات الإسرائيلية المتعاقبة إلى اقتطاع أو تجميد أجزاء من أموال المقاصة تحت ذرائع مختلفة، وهو ما أثار انتقادات فلسطينية وعربية ودولية متكررة، باعتبار هذه الإجراءات مخالفة للاتفاقيات الموقعة ومساهمة في تفاقم الأزمة الاقتصادية والمالية التي تواجهها السلطة الفلسطينية.
The Arab Parliament condemned in the strongest terms the Israeli occupation Knesset’s approval of a bill that expands the mechanisms for seizing Palestinian clearance funds, considering this step to represent a “crime of organized financial piracy” and a blatant violation of international law and the agreements signed between the two sides.
Arab Parliament President Mohammed bin Ahmed Al-Yamahi emphasized in an official statement that the continued occupation’s detention of legally due Palestinian funds constitutes a direct assault on the economic rights of the Palestinian people, and a deliberate attempt to suffocate the Palestinian economy, weaken the institutions of the Palestinian National Authority, and undermine its ability to fulfill its basic obligations towards its citizens.
He explained that Israeli policies are part of a comprehensive plan aimed at destroying the foundations of Palestinian life, alongside the ongoing war in the Gaza Strip, the escalation of settlement activities, land confiscation, forced displacement, and settler assaults in the West Bank and occupied Jerusalem, with the aim of imposing a new reality on the ground and undermining the legitimate national rights of the Palestinian people.
The Arab Parliament President stressed that the Israeli Knesset’s enactment of legislation allowing the seizure of Palestinian funds does not grant any legal legitimacy to these practices, but rather reveals the continuation of the policy of impunity enjoyed by the occupation due to the international community’s failure to take decisive action to stop its repeated violations.
Al-Yamahi called on the international community, the Security Council, and regional and international parliaments to bear their legal and moral responsibilities, and to take urgent action to pressure the occupation for the immediate and unconditional release of all withheld Palestinian clearance funds, and to hold it accountable for its violations of international law and international legitimacy resolutions.
He also demanded action to suspend the Israeli Knesset’s participation in international parliamentary forums, considering that it provides legislative cover for the occupation’s policies and its settlement and racist practices against the Palestinian people.
Clearance funds are tax and customs revenues collected by Israel on behalf of the Palestinian Authority for goods entering the Palestinian territories, under the economic arrangements stemming from the Oslo Agreement, and are then transferred monthly to the Palestinian Authority.
These funds constitute the main source of the Palestinian budget’s revenues, representing a significant percentage of the Authority’s income, making any deduction or freeze of these funds directly impact the Palestinian government’s ability to pay employee salaries and provide essential services.
In recent years, successive Israeli governments have resorted to deducting or freezing parts of the clearance funds under various pretexts, which has sparked repeated Palestinian, Arab, and international criticisms, considering these measures to be in violation of the signed agreements and contributing to the exacerbation of the economic and financial crisis facing the Palestinian Authority.
