بعد سنوات طويلة من استغلال منظومة الزواج كـ«بوابة سريعة ومضمونة» للحصول على الإقامة الدائمة والجنسية، قررت القيادة الروسية إغلاق أحد أكثر الملفات إثارة للجدل والتحايل داخل البلاد، عبر قانون جديد وصارم وقّعه الرئيس الروسي فلاديمير بوتين بنفسه لمواجهة ما يُعرف بـ«الزيجات الصورية أو الوهمية» بين المواطنين الروس والمهاجرين الأجانب.
ضربة قاضية لـ«بيزنس» الإقامات السريعة
فجّر القانون الجديد فور صدوره نقاشًا واسعًا وحالة من الارتباك، بعدما شددت موسكو شروط حصول الأجانب على الإقامة المؤقتة أو الدائمة، في خطوة وصفتها الأوساط الأمنية بأنها تهدف إلى بتر دابر التحايل الذي انتشر كالنار في الهشيم خلال السنوات الأخيرة عبر زيجات تجارية تُبرم على الورق فقط لمجرد شرعنة وجود المهاجرين قانونياً داخل الأراضي الروسية.
وبموجب التعديلات التشريعية الجديدة، لن يصبح مجرد عقد الزواج كافيًا للحصول على تصريح إقامة مبسط، إذ بات من الصعب الالتفاف على القانون بعد اشتراط أن يستمر الزواج الفعلي لمدة لا تقل عن 3 سنوات كاملة، مع وجود طفل مشترك يحمل الجنسية الروسية ويعيش بشكل دائم ومستقر داخل البلاد.
ولم تتوقف الشروط عند هذا الحد، بل ألزمت السلطات المهاجرين المتقدمين بإثبات العيش الفعلي والمشترك مع الطفل لسنوات، مع منح المحاكم والأجهزة الأمنية صلاحيات واسعة النطاق للتحقق السري من صحة العلاقة الأسرية وتفاصيل الحياة اليومية، قبل منح أي موافقة رسمية.
الأكثر صرامة في هذا التشريع، أن القانون الجديد يمنح السلطات الروسية الحق الكامل في سحب وإلغاء الإقامة فورًا وطرد الأجنبي إذا ثبت قضائياً أن الزواج كان صورياً، أو إذا جرى إبطال إثبات النسب أو التبني لاحقًا، وهو ما اعتبره مراقبون «ضربة قاصمة» للشبكات والسماسرة الذين يتربحون من استغلال ثغرات قوانين الهجرة.
وفي تعليق حاسم، أكد رئيس مجلس الدوما الروسي فياتشيسلاف فولودين أن هذه التشديدات الجديدة ستجعل من «الزواج الوهمي تجارة خاسرة وبلا أي فائدة»، في رسالة تحذيرية مباشرة وموجزة للمهاجرين الذين يسلكون هذا الدرب الالتوائي.
ويأتي هذا القرار في وقت تشهد فيه روسيا موجة تشدد غير مسبوقة تجاه ملف المهاجرين والعمالة الوافدة، وسط مخاوف رسمية من استغلال الثغرات لأغراض أمنية، بينما يرى خبراء حقوقيون أن هذه الإجراءات الصارمة قد تعقّد حياة آلاف العائلات المختلطة الحقيقية، وتفتح الباب على مصراعيه أمام رقابة مشددة تقتحم الحياة الشخصية للمقيمين.
After many years of exploiting the marriage system as a “quick and guaranteed gateway” to obtain permanent residency and citizenship, the Russian leadership decided to close one of the most controversial and exploitative files in the country through a new and strict law signed by Russian President Vladimir Putin himself to combat what is known as “sham or fictitious marriages” between Russian citizens and foreign migrants.
A Fatal Blow to the “Quick Residency Business”
The new law sparked a wide-ranging discussion and a state of confusion immediately upon its issuance, as Moscow tightened the conditions for foreigners to obtain temporary or permanent residency. This move was described by security circles as aimed at cutting off the manipulation that has spread like wildfire in recent years through commercial marriages that are concluded on paper only to legalize the presence of migrants within Russian territory.
Under the new legislative amendments, merely having a marriage contract will no longer be sufficient to obtain a simplified residency permit, as it has become difficult to circumvent the law after requiring that the actual marriage lasts for no less than 3 full years, with a shared child holding Russian citizenship and living permanently and stably within the country.
The conditions do not stop there; authorities have also mandated that migrant applicants prove actual and shared living with the child for years, granting courts and security agencies extensive powers to secretly verify the authenticity of the family relationship and details of daily life before granting any official approval.
The most stringent aspect of this legislation is that the new law grants Russian authorities the full right to immediately revoke residency and deport the foreigner if it is judicially proven that the marriage was sham, or if the proof of parentage or adoption is later invalidated. This has been considered by observers as a “crushing blow” to the networks and brokers profiting from exploiting loopholes in immigration laws.
In a decisive comment, the Chairman of the Russian State Duma, Vyacheslav Volodin, confirmed that these new strictures will make “sham marriages a losing and useless business,” in a direct and succinct warning message to migrants who pursue this convoluted path.
This decision comes at a time when Russia is witnessing an unprecedented wave of strictness regarding the issue of migrants and foreign labor, amid official concerns about exploiting loopholes for security purposes, while human rights experts believe that these stringent measures may complicate the lives of thousands of genuine mixed families and open the door wide to intensified scrutiny invading the personal lives of residents.
