في خطوة أسدلت الستار على واحدة من القضايا التي أثارت اهتمامًا واسعًا للرأي العام، أيدت محكمة النقض الحكم الصادر بمعاقبة المتهم في قضية التعدي على الطفل ياسين بمحافظة البحيرة بالسجن لمدة 10 سنوات، رافضة الطعن المقدم على الحكم.
وقضت محكمة النقض اليوم (الاثنين) برفض طعن المتهم بالتعدي على الطفل ياسين بالبحيرة، وصدر الحكم برئاسة القاضي عبد الحميد دياب.
وكانت محكمة جنايات دمنهور بمحافظة البحيرة، برئاسة المستشار أشرف عياد، عاقبت المتهم بالتعدي على الطفل ياسين بالسجن 10 سنوات.
وجاء قرار محكمة النقض ليؤكد الحكم الصادر من محكمة الجنايات بحق المتهم، بعدما انتهت المحكمة إلى سلامة الإجراءات وصحة الأدلة التي استند إليها الحكم الصادر بالإدانة.
وكانت القضية قد شغلت الرأي العام خلال الفترة الماضية، بعد تداول تفاصيل الواقعة وما صاحبها من مطالبات بتحقيق العدالة للطفل المجني عليه ومحاسبة المسؤول عن الجريمة وفقًا للقانون.
وأكدت المحكمة، من خلال قرارها برفض الطعن، نهائية العقوبة المقضي بها، ليصبح الحكم بالسجن لمدة 10 سنوات واجب النفاذ باعتباره آخر درجات التقاضي أمام المحاكم الجنائية.
ويعد حكم النقض محطة قانونية فاصلة في القضية، إذ يضع نهاية لمسار التقاضي ويؤكد حجية الأحكام القضائية الصادرة بعد استنفاد جميع الإجراءات القانونية المقررة.
وأكدت محكمة الموضوع في حيثيات حكمها أنه إزاء ما اطمأنت إليه من أدلة الثبوت التى ساقتها وإزاء تساند الأدلة القولية والفنية التى ارتاحت إليها على النحو المتقدم، إلى جانب تعرف الطفل المجني عليه على المتهم خلال العرض القانوني، وصدق رواية شهودها، ومما ثبت بتقرير الطب الشرعى.
وأوضحت المحكمة فى حيثياتها أن إنكار المتهم لا تعول عليه باعتباره ليس سوى وسيلة للتنصل من الاتهام والإفلات من العقاب وهو ما تأباه العدالة وترفضه المحكمة، ومتى كان ما تقدم فإنه يكون قد ثبت للمحكمة على سبيل القطع واليقين ثبوت التهمة على المتهم.

The Court of Cassation ruled today (Monday) to reject the appeal of the defendant accused of assaulting the child Yassin in Beheira, with the ruling presided over by Judge Abdel Hamid Diab.
The Damanhour Criminal Court in Beheira, presided over by Counselor Ashraf Ayad, had sentenced the defendant for the assault on the child Yassin to 10 years in prison.
The decision of the Court of Cassation confirmed the ruling issued by the Criminal Court against the defendant, after the court concluded that the procedures were sound and the evidence relied upon for the conviction was valid.
The case had occupied public opinion in the past period, following the circulation of details of the incident and the accompanying demands for justice for the victimized child and holding the perpetrator accountable according to the law.
The court emphasized, through its decision to reject the appeal, the finality of the imposed penalty, making the 10-year prison sentence enforceable as it represents the last level of litigation before the criminal courts.
The ruling of the Court of Cassation is a decisive legal milestone in the case, as it puts an end to the litigation process and affirms the authority of judicial rulings issued after exhausting all prescribed legal procedures.
The court confirmed in the reasoning of its ruling that, in light of the evidence it was assured of, and in light of the corroboration of the testimonial and technical evidence it relied upon as previously stated, along with the identification of the victimized child of the defendant during the legal presentation, and the credibility of its witnesses, as well as what was established in the forensic report.
The court clarified in its reasoning that the defendant’s denial cannot be relied upon as it is merely a means to evade the accusation and escape punishment, which justice rejects and the court will not accept. Therefore, it has been conclusively established to the court with certainty that the charge against the defendant is proven.
