حين حدَّث المشرِّع نظام نزع ملكية العقارات (دخل حيز التنفيذ: 29 رجب الماضي)؛ كان الهدف هو: تنظيم العلاقة بين الدولة والأفراد في ما يخص إجراءات نزع الملكية وحقوق الأفراد، وتوفير الأراضي والمساحات اللازمة لتحقيق أهداف «رؤية 2030».
المشاريع الضخمة وتطوير البنية التحتية وقطاع النقل والطاقة وتوسيع الحرمين الشريفين؛ تتطلب آليات سريعة وشفافة لتنفيذها، فيعمل النظام الجديد كمسرِّع لتلك المشاريع، مع ضمان أن تتم جميع عمليات التنفيذ وفقاً لأعلى معايير الشفافية والعدالة، وهذا الذي يبعث الطمأنينة في نفوس المستثمرين ومالكي العقارات.
النظام المُحدَّث يمثل تصحيحاً لمسار طويل من الإجراءات، إذ يقدم ضمانات غير مسبوقة للمواطن تختلف جذرياً عن النظام القديم؛ أبرزها:
أولاً: زيادة التعويض؛ فلم يعد التعويض مقتصراً على قيمة العقار فقط، بل ألزم النظام بإضافة مبلغ إضافي (نسبة 20% من القيمة السوقية) كتعويض عن الضرر الناتج عن نزع الملكية، وهو ما لم يكن منصوصاً عليه سابقاً.
ثانياً: احترافية التقييم؛ فتم استبدال لجان التقدير التقليدية بمقيمين معتمدين محترفين ومرخصين، لضمان تقييم العقار وفقاً للأسعار السوقية العادلة بدلاً عن التقديرات التي تكون في أغلب الأحيان غير ملائمة لقيمة العقار.
ثالثاً: ضمان الميزانية قبل البدء؛ فعالج النظام الجديد مشكلة تأخر التعويضات، إذ يمنع البدء في أي إجراء لنزع الملكية ما لم تكن الأموال مرصودة ومحجوزة في ميزانية الجهة صاحبة المشروع.
رابعاً: الإعفاءات والمرونة؛ فمنح النظام المواطن خياراً مرناً في التعويض (نقدي أو عيني)، كما أعفاه من ضريبة التصرفات العقارية عند شراء مسكن بديل خلال مدة خمس سنوات، لتخفيف الأعباء المالية.

يُعتبر هذا النظام بمثابة صمام أمان يضمن تسريع وتيرة التنمية، وضمان إطار من العدالة وحفظ الحقوق، محققاً المصلحة العامة دون المساس بالمصالح الخاصة.
When the legislator introduced the property expropriation system (which came into effect on the 29th of Rajab last month); the goal was to organize the relationship between the state and individuals regarding expropriation procedures and individual rights, and to provide the lands and spaces necessary to achieve the objectives of “Vision 2030”.
The massive projects and the development of infrastructure, transportation, and energy sectors, as well as the expansion of the two holy mosques; require fast and transparent mechanisms for their implementation, so the new system acts as an accelerator for those projects, ensuring that all execution processes are carried out according to the highest standards of transparency and justice, which instills reassurance in the hearts of investors and property owners.
The updated system represents a correction to a long path of procedures, as it offers unprecedented guarantees to citizens that are fundamentally different from the old system; the most notable of which are:
First: Increased compensation; compensation is no longer limited to the value of the property alone, but the system mandates the addition of an extra amount (20% of the market value) as compensation for the damage resulting from expropriation, which was not previously stipulated.
Second: Professional evaluation; traditional appraisal committees have been replaced with certified professional and licensed appraisers, to ensure that the property is evaluated according to fair market prices instead of estimates that are often inappropriate for the property’s value.
Third: Budget assurance before starting; the new system addresses the issue of delayed compensations, as it prohibits the initiation of any expropriation procedure unless the funds are allocated and reserved in the budget of the project owner.
Fourth: Exemptions and flexibility; the system grants citizens a flexible option for compensation (cash or in-kind), and exempts them from the real estate transaction tax when purchasing an alternative residence within five years, to alleviate financial burdens.
