للمرة الأولى في التاريخ، تخوض مئات العائلات الأمريكية والمراهقين والمناطق التعليمية مواجهة قانونية علنية ضد أقوى شركات التواصل الاجتماعي في العالم، متهمةً إياها بتصميم منصاتها عمداً بطريقة تُسبب الإدمان وتلحق أضراراً جسيمة بالصحة النفسية للأطفال.
وبحسب صحيفة الغاريان، تنطلق، الثلاثاء، في محكمة لوس أنجلوس العليا، سلسلة محاكمات غير مسبوقة قد يمثل خلالها عدد من الرؤساء التنفيذيين الكبار- من بينهم مؤسس «ميتا» مارك زوكربيرغ- للاستجواب تحت القسم.
اتهامات بإلحاق أذى واسع النطاق بالأطفال
وتشمل القضايا نحو 1,600 مدّعٍ، من بينهم أكثر من 350 أسرة و250 منطقة تعليمية، ويتهمون منصات «ميتا» (فيسبوك وإنستغرام)، و«سناب شات»، و«تيك توك»، و«يوتيوب» بالتسبب في الاكتئاب، واضطرابات الأكل، وإيذاء النفس، وأزمات نفسية أخرى لدى الأطفال والمراهقين بعد إدمانهم على هذه التطبيقات.
وقال مؤسس مركز ضحايا وسائل التواصل الاجتماعي ومحامي المدّعين ماثيو بيرغمان: «مجرد مثول شركة تواصل اجتماعي أمام هيئة محلفين هو أمر غير مسبوق في التاريخ القضائي الأمريكي».
أولى القضايا واختبار لهيئات المحلفين
ومن المتوقع أن تستمر أولى المحاكمات ما بين 6 إلى 8 أسابيع، وتتعلق بقضية شابة تبلغ من العمر 19 عاماً، عُرّفت في أوراق المحكمة بالحروف الأولى KGM، وتؤكد أنها أصيبت بمشكلات نفسية منذ طفولتها نتيجة إدمانها تطبيقات التواصل الاجتماعي.
وتُعد هذه القضية الأولى من نحو 22 محاكمة نموذجية (Bellwether Trials)، تُستخدم لقياس ردود فعل هيئات المحلفين وتوقع مسار آلاف القضايا الأخرى المجمعة ضمن إجراء قضائي منسق على مستوى ولاية كاليفورنيا.
مطالب بتعويضات وتغيير جذري في تصميم المنصات
ويسعى المدّعون إلى تعويضات مالية، إضافة إلى أوامر قضائية تُجبر الشركات على تعديل تصميم منصاتها ووضع معايير أمان شاملة على مستوى الصناعة.
وفي حال نجاح هذه القضايا، قد يؤدي ذلك إلى تغيير جذري في طريقة تصميم منصات التواصل الاجتماعي عالمياً، ويفتح الباب أمام موجة جديدة من الدعاوى القضائية ضد عمالقة التكنولوجيا.
رؤساء تنفيذيون تحت المجهر
ومن المتوقع أن يدلي بشهاداتهم كبار التنفيذيين، من بينهم: مارك زوكربيرغ (ميتا)، إيفان شبيغل (سناب شات)، آدم موسيري (إنستغرام)، فيما امتنعت «ميتا» و«سناب» عن التعليق، ورفضت «تيك توك» الإدلاء بأي تصريح، أما «يوتيوب»، فوصفت الاتهامات بأنها «غير صحيحة»، مؤكدة أن حماية المستخدمين الشباب «في صميم سياساتها».
وثائق سرية وشهادات صادمة
ويتوقع خبراء أن تكشف المحاكمات آلاف الوثائق الداخلية غير المعلنة، إضافة إلى شهادات مؤلمة لأطفال وأهالٍ تُنشر للمرة الأولى.
وقالت المحامية جوليا دنكان إن بعض الوثائق تتضمن اعترافات داخلية من موظفين يصفون التطبيقات بأنها «مخدرات»، ويشبّهون أنفسهم بـ«مروّجي إدمان»، في إشارة إلى خصائص مثل: التمرير اللانهائي، التشغيل التلقائي للفيديو، خوارزميات التوصية المصممة لإطالة زمن الاستخدام.
تشبيه بصناعة التبغ
ويعتمد فريق الادعاء على استراتيجية قانونية شبيهة بتلك التي أُستخدمت ضد شركات التبغ في تسعينيات القرن الماضي، حين أنكرت تلك الشركات لسنوات أن منتجاتها تسبب الإدمان رغم معرفتها بالأضرار.
وأكد بيرغمان أن هذه القضايا تمثل نقطة تحول قائلة: «هناك جيل كامل ضائع من الأطفال وما حدث لم يكن صدفة، بل نتيجة قرارات تصميم متعمدة».
معركة قانونية تتوسع
إلى جانب محاكم كاليفورنيا، من المقرر انطلاق محاكمات فيدرالية منفصلة في سان فرانسيسكو خلال يونيو المقبل، تشمل أكثر من 235 مدّعياً، من بينهم ولايات أمريكية ومدعون عامون من نحو 36 ولاية.
وتأتي هذه الدعاوى بعد شهادات مُبلّغين من داخل الشركات، وجلسات استماع ساخنة في الكونغرس، إذ وُجهت اتهامات مباشرة للمنصات بترويج محتوى يؤذي الأطفال.
وقالت جوليانا أرنولد، إحدى مؤسسات منظمة Parents RISE، التي توفيت ابنتها المراهقة عام 2022 بعد شراء مخدرات عبر إنستغرام: «كل أب وأم يعانون مع أطفالهم وهذه المنصات، كنا ننتظر هذه اللحظة منذ سنوات، لحظة خروج الحقيقة إلى العلن».
For the first time in history, hundreds of American families, teenagers, and school districts are engaging in a public legal battle against the world’s largest social media companies, accusing them of deliberately designing their platforms in a way that causes addiction and inflicts severe harm on children’s mental health.
According to The Guardian, on Tuesday, a series of unprecedented trials will begin in the Los Angeles Superior Court, during which several top executives—including Meta founder Mark Zuckerberg—are expected to testify under oath.
Allegations of Widespread Harm to Children
The lawsuits involve around 1,600 plaintiffs, including more than 350 families and 250 school districts, who accuse Meta’s platforms (Facebook and Instagram), Snapchat, TikTok, and YouTube of causing depression, eating disorders, self-harm, and other mental health crises among children and teenagers after they became addicted to these apps.
Matthew Bergman, founder of the Social Media Victims Center and attorney for the plaintiffs, stated: “The mere appearance of a social media company before a jury is unprecedented in American legal history.”
The First Cases and a Test for Juries
The first trials are expected to last between 6 to 8 weeks and relate to the case of a 19-year-old woman, identified in court documents by the initials KGM, who claims she has suffered mental health issues since childhood due to her addiction to social media applications.
This case is the first of about 22 bellwether trials used to gauge jury reactions and predict the trajectory of thousands of other cases consolidated under a coordinated legal procedure in California.
Demands for Compensation and Radical Changes in Platform Design
The plaintiffs are seeking financial compensation, in addition to court orders that would force companies to modify their platform designs and implement comprehensive safety standards across the industry.
If these cases succeed, it could lead to a radical change in how social media platforms are designed globally, opening the door to a new wave of lawsuits against tech giants.
Executives Under Scrutiny
Top executives are expected to testify, including: Mark Zuckerberg (Meta), Evan Spiegel (Snapchat), and Adam Mosseri (Instagram), while Meta and Snap have declined to comment, and TikTok refused to make any statement. YouTube described the allegations as “false,” asserting that protecting young users is “at the core of its policies.”
Confidential Documents and Shocking Testimonies
Experts expect the trials to reveal thousands of undisclosed internal documents, along with painful testimonies from children and parents published for the first time.
Attorney Julia Duncan stated that some documents include internal confessions from employees describing the apps as “drugs,” comparing themselves to “addiction dealers,” referring to features such as: infinite scrolling, autoplay videos, and recommendation algorithms designed to prolong usage time.
Comparison to the Tobacco Industry
The prosecution team is relying on a legal strategy similar to that used against tobacco companies in the 1990s, when those companies denied for years that their products caused addiction despite knowing the harms.
Bergman emphasized that these cases represent a turning point, saying: “There is a whole lost generation of children, and what happened was not an accident, but the result of deliberate design decisions.”
A Legal Battle Expanding
In addition to California courts, separate federal trials are set to begin in San Francisco next June, involving more than 235 plaintiffs, including U.S. states and attorneys general from about 36 states.
These lawsuits follow whistleblower testimonies from within the companies and heated congressional hearings, where platforms were directly accused of promoting content that harms children.
Julianna Arnold, one of the founders of the Parents RISE organization, whose teenage daughter died in 2022 after purchasing drugs through Instagram, said: “Every parent struggling with their children and these platforms has been waiting for this moment for years, the moment the truth comes to light.”
