أثار قرار إحالة قضية طيار أمريكي متهم بالاعتداء جنسيا على امرأة بريطانية وخنقها إلى القضاء العسكري الأمريكي، بدلا من محاكمته أمام المحاكم البريطانية، خلافا داخل المؤسسات البريطانية، بعدما اعتبر مسؤولون في وزارة الدفاع أن الخطوة تمثل انتهاكا لاتفاقية تنظم الاختصاص القضائي بين لندن وواشنطن منذ عقود.
وتعود تفاصيل القضية إلى اتهام النقيب الأمريكي جاكوب وولفسون بالاعتداء جنسيا على سارة ستيل وخنقها داخل شقته بمدينة كامبريدج، قبل أن تتولى الشرطة العسكرية الأمريكية التحقيق معه، وينتقل ملف القضية من القضاء الجنائي الإنجليزي إلى محكمة عسكرية داخل قاعدة جوية أمريكية في مقاطعة سوفولك المجاورة.
وكشفت وثائق حصلت عليها صحيفة «الجارديان» البريطانية بموجب قانون حرية المعلومات، أن مسؤولين بوزارة الدفاع البريطانية اعترضوا على قرار شرطة كامبريدجشاير السماح للشرطة العسكرية الأمريكية بتولي التحقيق، مؤكدين أنه لم يكن ينبغي الموافقة على هذه الخطوة «بأي حال من الأحوال»، واعتبروها انتهاكا صريحا للاتفاقية المبرمة بين البلدين.
اتفاقية تثير الجدل
وتنظم الاتفاقية، الموقعة قبل عقود، الاختصاص القضائي في الجرائم التي يرتكبها عسكريون أمريكيون داخل الأراضي البريطانية، إذ تمنح الشرطة البريطانية الحق الأساسي في التحقيق، مع استثناءات محددة تسمح للسلطات الأمريكية بتولي القضية، أبرزها وقوع الجريمة أثناء أداء العسكري مهامه الرسمية، أو استهداف أحد أفراد القوات المسلحة الأمريكية أو ممتلكاتها.
ويرى مسؤولون بريطانيون أن الواقعة لا تندرج ضمن هذه الاستثناءات، لأن الاعتداء المزعوم وقع داخل مسكن خاص، ولم يكن الطيار يؤدي مهمة عسكرية وقت الحادث، ما يثير تساؤلات بشأن الأساس القانوني الذي استندت إليه الشرطة المحلية في إحالة التحقيق إلى الجانب الأمريكي.
السجن 6 أشهر والبراءة من الاعتداء الجنسي
وخلال المحاكمة أمام القضاء العسكري الأمريكي، أُدين وولفسون بتهمة خنق شريكته، فيما بُرئ من تهمة الاعتداء الجنسي، وصدر بحقه حكم بالسجن ستة أشهر، إلى جانب فصله من القوات الجوية الأمريكية.
وكان الكشف عن القضية في يونيو الماضي قد أثار انتقادات من مقر رئاسة الوزراء البريطانية «داونينغ ستريت»، الذي وصف ما حدث بأنه «مؤلم للغاية» و«مقلق جدا»، خصوصا أن المحاكمة جرت أمام القضاء العسكري الأمريكي دون مشاركة السلطات البريطانية في إجراءاتها.
تحقيق حكومي لكشف ملابسات القضية
وتعتزم الحكومة البريطانية تشكيل لجنة تحقيق رفيعة المستوى لفحص ملابسات نقل القضية إلى الشرطة العسكرية الأمريكية، وتحديد أسباب تخلي الشرطة المحلية عن التحقيق، وما إذا كانت هناك وقائع أخرى تنازلت فيها أجهزة الشرطة البريطانية عن اختصاصها في جرائم خطيرة ارتكبها عسكريون أمريكيون.
وتعيد القضية فتح النقاش في بريطانيا حول حدود الحصانة والاختصاص القضائي للقوات الأجنبية، في ظل الوجود العسكري الأمريكي داخل المملكة المتحدة، وما يفرضه ذلك من تساؤلات بشأن حقوق المدنيين البريطانيين وضمان خضوع المتهمين من أفراد القوات الأجنبية للقوانين والإجراءات القضائية المعمول بها داخل البلاد.
The decision to refer the case of an American pilot accused of sexually assaulting and choking a British woman to the U.S. military court, instead of being tried in British courts, has sparked a controversy within British institutions, as officials in the Ministry of Defense considered the step a violation of an agreement that has governed jurisdiction between London and Washington for decades.
The details of the case date back to the accusation against Captain Jacob Wolfson of sexually assaulting Sarah Steele and choking her inside his apartment in Cambridge, before the U.S. military police took over the investigation, and the case file was transferred from the English criminal justice system to a military court at an American airbase in neighboring Suffolk.
Documents obtained by the British newspaper “The Guardian” under the Freedom of Information Act revealed that officials at the British Ministry of Defense objected to the decision by Cambridgeshire police to allow the U.S. military police to take over the investigation, asserting that this step should not have been approved “under any circumstances,” and considered it a blatant violation of the agreement between the two countries.
A Controversial Agreement
The agreement, signed decades ago, governs jurisdiction over crimes committed by American military personnel on British soil, granting British police the primary right to investigate, with specific exceptions allowing U.S. authorities to take over the case, most notably if the crime occurred while the military member was performing official duties, or if it involved targeting a member of the U.S. armed forces or its property.
British officials believe that the incident does not fall within these exceptions, as the alleged assault took place in a private residence, and the pilot was not on a military mission at the time of the incident, raising questions about the legal basis on which local police relied to refer the investigation to the American side.
Six Months in Prison and Acquittal of Sexual Assault
During the trial before the U.S. military court, Wolfson was convicted of choking his partner, while he was acquitted of the charge of sexual assault, receiving a six-month prison sentence, in addition to being discharged from the U.S. Air Force.
The revelation of the case last June drew criticism from the British Prime Minister’s Office, “Downing Street,” which described what happened as “extremely painful” and “very concerning,” especially since the trial took place before the U.S. military court without the involvement of British authorities in its proceedings.
Government Investigation to Uncover the Circumstances of the Case
The British government intends to form a high-level inquiry committee to examine the circumstances surrounding the transfer of the case to the U.S. military police, determine the reasons for the local police’s abandonment of the investigation, and whether there have been other instances where British police authorities relinquished their jurisdiction in serious crimes committed by American military personnel.
The case reopens the discussion in Britain regarding the limits of immunity and jurisdiction of foreign forces, in light of the American military presence within the United Kingdom, and the questions it raises about the rights of British civilians and the assurance that accused members of foreign forces are subject to the laws and judicial procedures in effect within the country.
