The President Cuts His Trip to Senegal and Intervenes in the CrisisOngoing Judicial Crisis Since 2015 Threatens Poland’s StabilityWashington Warns of an Escalating Political Confrontation

Poland has entered a new phase of political and judicial escalation, following clashes between police and protesters outside the Constitutional Court in the capital, Warsaw, after a controversial decision to suspend the duties of the court’s president and his deputy, marking the latest chapter in a legal and political crisis that has persisted for nearly a decade regarding the legitimacy and independence of the judiciary.

The area around the court witnessed heightened tension on Friday evening, after a group of judges appointed by the government decided to suspend the duties of Constitutional Court President Bohdan Święczkowski and his deputy Bartłomiej Sychowski, amid sharp disagreements over the legitimacy of the court’s formation and the authorities responsible for managing its affairs.

The decision sparked outrage from the opposition Law and Justice Party (PiS), with its leader Jarosław Kaczyński describing the events as an “assault” on the court, while government opponents considered the move a coup against the judiciary.

The President Cuts His Trip to Senegal and Intervenes in the Crisis

In a notable development, Polish conservative President Karol Nawrotowski, known for his close alliance with U.S. President Donald Trump, decided to return to Warsaw after changing the course of his plane while heading to Senegal on an official visit, to intervene in the crisis.

Hundreds of protesters, including opposition deputies, gathered outside the court building to express their support for the suspended judges. The police announced the arrest of three individuals after some protesters breached the fence surrounding the court, while others threw objects at security forces.

Just before 1 AM on Saturday, Nawrotowski appeared outside the court, managed to cross the security cordon, and entered the building, as a video showed him clashing with security personnel and other judges during his attempt to reach the interior.

By 4 AM local time, the president was still inside the building.

In a video posted online, Nawrotowski stated that the judges appointed by the government “are not judges of the Constitutional Court.”

In a statement read by a representative before the court at 5 AM, the president criticized what he described as a “violation of the Polish constitutional order,” considering that “a constitutional body has been forcibly seized,” and he demanded that security forces leave the court premises.

Ongoing Judicial Crisis Since 2015 Threatens Poland’s Stability

The roots of the crisis date back to 2015, when two successive governments, one centrist and the other right-wing, took rapid and controversial steps to appoint judges loyal to them within the Constitutional Court, leading to a prolonged dispute over the legitimacy of the appointments and the formation of the judiciary.

The disagreements caused paralysis in the court, which worsened during the eight years that the Law and Justice Party ruled, amid accusations against the government at the time of undermining judicial independence and repeated clashes with the European Union regarding respect for the rule of law.

Since returning to power in 2023, Prime Minister Donald Tusk has pledged to abolish the controversial judicial reforms and restore relations with Brussels to their normal course, but he has refused to recognize the legitimacy of the court in its current formation.

However, his attempts have collided with conservative leaders allied with the opposition, who used veto powers and expansive interpretations of their authorities to obstruct reforms.

In a new development this year, Nawrotowski, who unexpectedly won the presidential election last year against Tusk’s candidate, refused to take the constitutional oath before five judges elected by the current parliament, complicating the legal situation of the court further.

Earlier this month, the Venice Commission, the advisory body of the Council of Europe concerned with the rule of law, confirmed that the president’s refusal to have the judges take the oath should not prevent them from assuming their positions.

Judges Disputing the Legitimacy of the Court’s Presidency

In the latest chapter of the crisis, a group of judges elected by the current parliament majority moved on Friday evening to suspend Święczkowski, who previously held a ministerial position in the Law and Justice Party government, and to take control of the court’s administrative procedures.

Judge Anna Korwin-Piotrowska, one of the five judges Nawrotowski refused to accept, announced that she would assume the highest position in the court, citing her longer experience in the judiciary.

However, the move sparked division among legal experts regarding its legitimacy, with Marcin Matczak, a law professor and one of the prominent critics of the Law and Justice Party, stating that he never imagined he would find himself defending Święczkowski, but he believes that the legal basis for suspending his duties “does not exist.”

In a parallel legal move, Polish Justice Minister Waldemar Żurek announced that he had requested to lift the legal immunity of Święczkowski and his deputy, in preparation for prosecuting them for obstructing the court’s work.

Tusk Insists on Judicial Reform… and the Opposition Accuses Him of a Coup

Despite the rising criticisms, Prime Minister Donald Tusk defended his government’s actions, asserting that “restoring the rule of law is our duty.”

He added that the process comes after years of legal transgressions during the Law and Justice Party’s rule, and while it may be difficult and painful at times, it requires decisive actions, emphasizing that there is no other way.

Tusk had previously pledged earlier this month that the court would begin its work according to the constitution, whether some liked it or not.

For his part, Polish Foreign Minister Radosław Sikorski, on the sidelines of a G20 meeting in Atlanta, stated that the Constitutional Court had been politicized during the previous government.

He added that what is currently happening aims to enable the majority of legally elected judges to restart the court and resume its work.

In contrast, opposition leaders and the official court account on social media accused the government of executing a “judicial coup,” while several far-right figures in Europe condemned the actions, including British figures Nigel Farage and Liz Truss, and Dutch politician Geert Wilders.

Washington Warns of an Escalating Political Confrontation

In a comment on the developments, U.S. Ambassador to Poland Tom Rose described the escalating events as “very serious” in a post on the platform “X.”

He noted that both sides are presenting sharply differing narratives about what happened and its causes, warning that the gathering of thousands of people outside the court increases the danger of the situation and makes it more combustible.

He added that the last thing Poland needs is a confrontation escalating to a more dangerous level.

The crisis threatens further political polarization within the country, especially with the parliamentary elections scheduled for next year, amid opinion polls indicating that the populist right has a chance to return to power, making the confrontation over the Constitutional Court one of the most prominent political battles in Poland.
