The Zakat, Tax and Customs Authority has revealed new mechanisms and procedures that allow individuals to reclaim the value-added tax that is not due on their real estate sales, in addition to recovering related tax penalties that have been previously paid, and canceling any unduly taxes and penalties that have not been settled.
According to the decision, value-added tax is not due on real estate sales for individuals who have not engaged in real estate activity continuously and regularly for the purpose of generating income, before the application of the real estate transaction tax on October 4, 2020, unless the individual has executed more than one sale transaction within 12 months, the total value of which exceeds the mandatory registration threshold for value-added tax.
Refund of Paid Taxes
The mechanisms clarified that an individual who has paid an undue tax or related penalties, whether through voluntary disclosure, a decision issued by the authority, or a judicial ruling, has the right to file a claim before the committees for resolving violations and disputes related to zakat, tax, and customs to request the refund of amounts, provided that the input tax related to the property in question has not been deducted, and that they have not previously reclaimed the tax from another government entity.
The mechanisms specified a period of 30 days to refer the refund claim directly to the relevant courts, starting from today (Tuesday).
Cancellation of Unpaid Penalties
The decision stipulated the cancellation of the undue value-added tax and related penalties if the individual has not previously paid them, through amending the tax declaration or the assessment issued by the authority.
It also approved exempting individuals who owe tax from unpaid tax penalties imposed on their real estate supplies during the period from January 1, 2018, to October 4, 2020, after settling the principal due tax, with the exception of penalties resulting from tax evasion violations.
The procedures confirmed that individuals who have previously deducted the input tax related to their real estate sales do not benefit from the cancellation or refund of the tax under these mechanisms, although they can benefit from the exemption from unpaid penalties according to the approved regulations.
The mechanisms granted the authority the power to verify the eligibility of beneficiaries for refunds or cancellations, and to take legal actions to claim taxes and penalties in case it is proven that the exemption or refund is not justified.
The decision will be effective from the date of its publication in the official gazette, which is October 13, 2026.
