أعلنت النيابة العامة الكويتية، اليوم (الخميس)، إحالة متهمين تابعين للحرس الثوري الإيراني إلى المحكمة المختصة لمباشرة محاكمتهم بعد أن ضبطوا عقب توغل غير مشروع داخل أراضي الدولة.
ونقلت وكالة الأنباء الكويتية «كونا»، عن بيان للنيابة، تأكيده أن الأفعال المسندة إلى المتهمين شملت خرق سيادة الدولة واختراق حدودها والتوغل داخل نطاق عسكري محظور واستهدافها مواقع ومنشآت ذات طبيعة عسكرية وسيادية وما اقترن بها من شروع في قتل أفراد القوات المسلحة، مبيناً أن تلك الأفعال تشكل في مجموعها مساساً بوحدة البلاد وسلامة أراضيها وأمنها العسكري وتنطوي على جناية العدوان المؤثمة بموجب المرسوم بقانون رقم (156) لسنة 2025، بشأن مكافحة الجرائم الدولية، فضلاً عما تشكله من جرائم أخرى معاقب عليها بموجب قانون الجزاء وتعديلاته.
خرق سيادة الكويت
وأضاف البيان أن هذه الأفعال تشكل خرقاً جسيماً لأحكام المرسوم بقانون رقم (13) لسنة 2026، بشأن تأمين وحماية المصالح العليا للجهات العسكرية بما يمثله من سياج قانوني خاص لحماية المناطق العسكرية والمنشآت السيادية والحدود والمواقع الخاضعة للحراسة وصون المصالح العسكرية العليا للدولة.
وأشار إلى تفاصيل الواقعة، إذ تم ضبط عدد من العناصر التابعة للحرس الثوري الإيراني عقب توغلهم غير المشروع داخل إقليم الدولة واجتيازهم حدودها البحرية والتسلل إلى نطاق عسكري محظور وذلك إثر رصدهم من قبل رجال القوات المسلحة المكلفة بتأمين الموقع واعتراضهم داخل المنطقة العسكرية، موضحاً أن الواقعة كشفت عملية منظمة نفذت بإعداد مسبق وتنسيق محكم باستخدام قوارب وتجهيزات ملاحية وميدانية وبحوزتهم أسلحة وذخائر وأجهزة اتصال ورصد بقصد استهداف مواقع ومنشآت ذات طبيعة عسكرية وسيادية وأمنية.
وذكر البيان أن تلك الأفعال تجسدت بما صاحبها من تنظيم وإخفاء وتدبير عسكري مسبق وما اقترن بها من شروع في قتل أفراد القوة القائمة بالحراسة بإطلاق النار عليهم في عمل عدائي استهدف سيادة الدولة وحرمة إقليمها وأمنها والنيل من استقرارها ومصالحها العليا.
تفاصيل التحقيقات التي أجرتها
وذكرت النيابة العامة أنها باشرت إجراءات التحقيق فور إحالة المتهمين إليها فانتقل فريق التحقيق إلى مباشرة أعماله، إذ تم استجواب المتهمين ومواجهتهم بما ثبت بالأدلة والقرائن والانتقال إلى موقع الواقعة لإجراء معاينة ميدانية شاملة ورفع الآثار المادية والفنية المرتبطة بها والاستماع إلى أقوال الشهود وأفراد القوة القائمة بتأمين الموقع.
وأفادت النيابة أنها ندبت الإدارة العامة للأدلة الجنائية لإجراء الفحوص الفنية المتخصصة على الأسلحة والذخائر والأجهزة والمضبوطات وتحليل الآثار وإجراء المضاهاة الفنية اللازمة وذلك في إطار استكمال النيابة العامة كافة إجراءات التحقيق وصولاً إلى الإحاطة الكاملة بملابسات الواقعة وظروفها ودوافعها وامتداداتها والكشف عن جميع ما اتصل بها من أفعال ووقائع وارتباطات، مبينة أنها انتهت على ضوء ما أسفرت عنه التحقيقات والإجراءات المتخذة إلى إحالة المتهمين إلى المحكمة المختصة لمباشرة محاكمتهم عما أسند إليهم من جرائم.
وشددت النيابة العامة على أن سيادة الدولة وسلامة أراضيها وأمنها من الثوابت الدستورية والقانونية التي لا تحتمل تهاوناً أو انتقاصاً والتي أحاطها الدستور والقانون بالحماية والذود.
وأكدت أن أمن دولة الكويت وسلامة أراضيها ومصالحها العليا ليست محلاً للمساومة أو التهاون بل هي التزام وطني وقانوني ودولي تصونه الدولة بأجهزتها ويحرسه القانون بسلطانه.
كما شددت على أن يد العدالة ستظل قائمة في مواجهة كل فعل يستهدف كيان الدولة أو يمس حرمة حدودها أو يهدد أمنها واستقرارها ومصالحها السيادية العليا.
تفاصيل عملية إحباط التسلل
وكان المتحدث باسم وزارة الدفاع الكويتية العقيد الركن سعود العطوان أعلن في الثالث من مايو الجاري أن القوات المسلحة تمكنت من إحباط عملية تسلل بحرية عبر المياه الإقليمية الكويتية، إذ تم ضبط 4 متسللين حاولوا دخول البلاد عن طريق البحر بطريقة غير مشروعة وتمت إحالتهم للجهات المختصة، فيما ذكرت وزارة الداخلية في 12 مايو الجاري أن مجموعة المتسللين أقروا أثناء التحقيق معهم من جهات الاختصاص بانتمائهم إلى الحرس الثوري الإيراني، وهم عقيد بحري أمير حسين عبد محمد زراعي، وعقيد بحري عبدالصمد يداله قنواتي، ونقيب بحري أحمد جمشيد غلام رضا ذو الفقاري، وملازم أول بري محمد حسين سهراب فروغي راد.
The Kuwaiti Public Prosecution announced today (Thursday) the referral of defendants affiliated with the Iranian Revolutionary Guard to the competent court to commence their trial after they were apprehended following an unlawful incursion into the state’s territory.
The Kuwaiti News Agency “KUNA” reported a statement from the prosecution confirming that the actions attributed to the defendants included violating the sovereignty of the state, breaching its borders, penetrating a prohibited military area, and targeting military and sovereign sites and facilities, along with the attempted murder of armed forces personnel. It indicated that these actions collectively constitute a violation of the unity of the country, the integrity of its territory, and its military security, and involve a felony of aggression punishable under Decree Law No. (156) of 2025 regarding the fight against international crimes, in addition to other crimes punishable under the Penal Code and its amendments.
Violation of Kuwaiti Sovereignty
The statement added that these actions represent a serious violation of the provisions of Decree Law No. (13) of 2026 concerning the security and protection of the supreme interests of military entities, which serves as a special legal framework for protecting military areas, sovereign facilities, borders, and guarded sites, and safeguarding the supreme military interests of the state.
It pointed to the details of the incident, as a number of elements affiliated with the Iranian Revolutionary Guard were apprehended following their unlawful incursion into the state’s territory and crossing its maritime borders, infiltrating a prohibited military area after being detected by armed forces personnel tasked with securing the site and intercepting them within the military zone. It clarified that the incident revealed an organized operation carried out with prior preparation and meticulous coordination using boats and navigational and field equipment, along with possession of weapons, ammunition, and communication and surveillance devices aimed at targeting military, sovereign, and security sites and facilities.
The statement mentioned that these actions manifested through the organization, concealment, and prior military planning, along with the attempted murder of the guarding personnel by firing at them in an aggressive act targeting the sovereignty of the state, the sanctity of its territory, its security, and undermining its stability and supreme interests.
Details of the Investigations Conducted
The Public Prosecution stated that it initiated investigation procedures immediately upon referral of the defendants, as the investigation team moved to commence its work, where the defendants were interrogated and confronted with the evidence and indications, and a comprehensive field inspection of the incident site was conducted to collect the material and technical evidence associated with it, as well as listening to the testimonies of witnesses and the personnel securing the site.
The prosecution indicated that it assigned the General Department of Criminal Evidence to conduct specialized technical examinations on the weapons, ammunition, devices, and seized items, analyze the evidence, and carry out the necessary technical comparisons, all within the framework of completing the Public Prosecution’s investigation procedures to fully understand the circumstances, conditions, motivations, and extensions of the incident, and to uncover all actions, events, and connections related to it. It stated that based on the findings of the investigations and the procedures taken, it referred the defendants to the competent court to commence their trial for the crimes attributed to them.
The Public Prosecution emphasized that the sovereignty of the state, the integrity of its territory, and its security are constitutional and legal constants that do not tolerate negligence or diminishment, which the constitution and law protect and defend.
It affirmed that the security of the State of Kuwait, the integrity of its territory, and its supreme interests are not subjects for bargaining or leniency but are a national, legal, and international obligation upheld by the state through its institutions and protected by the law with its authority.
It also stressed that the hand of justice will remain firm against any act targeting the entity of the state or infringing its borders or threatening its security, stability, and supreme sovereign interests.
Details of the Infiltration Prevention Operation
The spokesperson for the Kuwaiti Ministry of Defense, Colonel Saud Al-Otaibi, announced on May 3 that the armed forces managed to thwart a maritime infiltration attempt through Kuwaiti territorial waters, as four infiltrators were apprehended while attempting to enter the country illegally by sea and were referred to the relevant authorities. Meanwhile, the Ministry of Interior reported on May 12 that the group of infiltrators admitted during their interrogation by the relevant authorities that they belonged to the Iranian Revolutionary Guard, including Navy Colonel Amir Hossein Abd Mohammad Zarai, Navy Colonel Abd Al-Samad Yadal Qanati, Navy Captain Ahmad Jamshid Gholam Reza Zolfaghari, and First Lieutenant Mohammad Hossein Sohrab Foroughi Rad.
