Our cities of Gdańsk and Białystok in Poland witnessed protests organized by supporters of right-wing parties on Monday evening, demanding the resignation of Donald Tusk’s government in light of the escalating conflict regarding the Constitutional Tribunal.
Protesters gathered in front of the headquarters of two courts in the cities, protesting the suspension of the duties of the President of the Constitutional Tribunal, Bohdan Święczkowski, and his deputy Bartłomiej Sochański, a step taken by Judge Anna Korwin-Piotrowska, which sparked a political and legal confrontation between the government and the opposition.
The participants raised slogans condemning what they described as an attempt to seize the Constitutional Tribunal, accusing Tusk’s government of overstepping its powers and interfering in the work of the judiciary. They also called for the government’s resignation, considering that recent measures threaten the constitutional order in the country.
In Gdańsk, right-wing forces organized a rally in front of the Court of Appeal under the slogan “Defending the Constitutional Tribunal,” with the participation of politicians from the conservative Law and Justice Party and the Confederation Movement. In Białystok, supporters of the Law and Justice Party, the Confederation, and the National Movement gathered in front of the regional court to protest against the changes that affected the leadership of the Constitutional Tribunal.
This comes after rapid developments at the Constitutional Tribunal on October 30, when Judge Anna Korwin-Piotrowska announced the suspension of the official duties of the court’s president, Święczkowski, and his deputy Sochański, taking over the supervision of the institution’s work, citing the necessity to stop the obstruction of the court’s operations.
However, the court’s president and his supporters rejected the decision, announcing that Święczkowski still holds his position, and considered what happened to be an illegal seizure of the institution, while opposition figures accused the government of orchestrating what they described as a “coup against the Constitutional Tribunal.”
The confrontation intensified with police intervention to secure the court’s headquarters in Warsaw, leading to clashes between security forces and protesters, while Polish President Karol Nawrocki cut short his visit to Senegal and returned to the country to monitor developments, stating that the situation required his presence in Warsaw.
In contrast, Tusk defended the actions taken by the judges supported by the parliamentary majority, stating that restoring the rule of law and ensuring the independence of the judiciary requires decisive steps, following what he described as a legacy of abuses during the rule of the Law and Justice Party from 2015 to 2023.
The roots of the crisis date back to ongoing disputes since 2015 regarding the appointment of judges to the Constitutional Tribunal and its independence from political power. At that time, opposition forces accused the ruling Law and Justice Party of politicizing the judiciary and appointing judges to positions previously held, leading to a constitutional dispute that continued in the following years.
Since Tusk’s coalition came to power in 2023, it has sought to reform the judiciary and reshape the tribunal, but its efforts have faced opposition from President Nawrocki, an ally of the Law and Justice Party, who refused to administer the oath of office to several judges chosen by parliament, and the court’s president also refused to allow some of them to assume their duties.
