فتحت وزارة العدل الأمريكية تحقيقاً مع خمس شبكات تلفزيونية كبرى، هي «إيه بي سي» و«سي بي إس» و«سي إن إن» و«إن بي سي» و«فوكس نيوز»، للاشتباه في احتمال مخالفتها قوانين مكافحة الاحتكار، بعدما علّقت تغطية فعاليات الرئيس دونالد ترمب احتجاجاً على استبعاد مؤسسات إعلامية من البيت الأبيض.

وذكرت صحيفة «نيويورك تايمز»، ونقلت عنها وسائل إعلام أمريكية، أن الشبكات تلقت إخطاراً من الوزارة بشأن التحقيق، الذي يركز على قرارها الجماعي وقف تغطية فعاليات البيت الأبيض ضمن نظام التغطية التلفزيونية المشتركة، وما إذا كان ذلك يمثل مقاطعة منسقة بين مؤسسات إعلامية متنافسة بالمخالفة للقانون الأمريكي.

وأكدت المتحدثة باسم وزارة العدل، إميلي كوفينغتون، أن قسم مكافحة الاحتكار يحقق لتحديد ما إذا كانت المؤسسات الإعلامية قد انتهكت القوانين ذات الصلة، موضحة أن المقاطعات الجماعية بين الشركات المتنافسة قد تخالف قانون شيرمان لمكافحة الاحتكار. ولم تعلن الوزارة توجيه اتهامات رسمية إلى الشبكات، إذ لا يزال الإجراء في مرحلة التحقيق.

ويعود الخلاف إلى سبتمبر الماضي، عندما قررت إدارة ترمب منع صحفيين من شبكة «سي إن إن» وقناة «إم إس ناو» وصحيفة «بوليتيكو» من دخول البيت الأبيض، بعدما اتهم الرئيس هذه المؤسسات بنشر «أخبار مزيفة»، حيث أثار القرار اعتراضات واسعة من المؤسسات الإعلامية، التي اعتبرت استبعاد الصحفيين بسبب تغطيتهم انتهاكاً لحرية الصحافة والتعديل الأول للدستور الأمريكي.

ورداً على القيود، علّقت الشبكات الخمس تغطيتها المشتركة لفعاليات الرئيس، في خطوة تضامنية مع المؤسسات المستبعدة. وشمل القرار «فوكس نيوز»، التي يُنظر إليها على نطاق واسع باعتبارها أقرب إلى ترمب سياسياً، إلى جانب «إيه بي سي» و«سي بي إس» و«إن بي سي» و«سي إن إن»، قبل أن تستأنف الشبكات التغطية لاحقاً.

ويعتمد نظام التغطية التلفزيونية المشتركة في البيت الأبيض على تناوب المؤسسات الإعلامية المشاركة في تغطية تحركات الرئيس وجمع الصور والمقاطع المصورة وتوزيعها على وسائل إعلام أخرى، بما يتيح تغطية الفعاليات التي لا تتسع لاستقبال جميع الصحفيين.

وترى وزارة العدل أن تعليق هذا النظام بصورة جماعية قد يثير تساؤلات تتعلق بقواعد المنافسة، بينما يربط منتقدو التحقيق الخطوة بحق المؤسسات الإعلامية في اتخاذ موقف مهني مشترك إزاء القيود المفروضة على الوصول إلى مصادر الأخبار.

ولم يقتصر النزاع على تبادل التصريحات؛ إذ رفعت «سي إن إن» و«إم إس ناو» و«بوليتيكو» دعاوى قضائية ضد إدارة ترمب، معتبرة أن استبعادها بسبب مضمون تغطيتها يمثل تمييزاً على أساس وجهة النظر وانتهاكاً للتعديل الأول.

وأمر قاضٍ اتحادي في سبتمبر بإعادة صلاحيات دخول الصحفيين المعنيين، معتبراً أن الحظر يبدو غير دستوري على الأرجح، فيما استمرت خلافات بشأن الوصول إلى بعض الفعاليات والرحلات الرئاسية.

وتنص المادة الأولى من الدستور الأمريكي على حماية حرية التعبير والصحافة، لكنها لا تمنح المؤسسات الإعلامية بالضرورة حق الوصول غير المقيد إلى كل موقع أو فعالية رئاسية، حيث يتمحور النزاع القانوني حول ما إذا كانت قيود الإدارة تستند إلى معايير مشروعة ومحايدة، أم أنها جاءت رداً على تغطية إعلامية لا تحظى بقبول الرئيس.

وأثار التحقيق الجديد انتقادات من جهات معنية بحرية الصحافة، حذرت من أن استخدام قوانين مكافحة الاحتكار ضد مؤسسات إعلامية بسبب موقف اتخذته دفاعاً عن حق الوصول الصحفي قد يثير مخاوف من التأثير في استقلال وسائل الإعلام. وفي المقابل، تقول وزارة العدل إن هدف التحقيق هو التحقق من الالتزام بقواعد المنافسة، وليس إصدار حكم مسبق على الشبكات.

The U.S. Department of Justice has opened an investigation into five major television networks: ABC, CBS, CNN, NBC, and Fox News, on suspicion of potentially violating antitrust laws after they suspended coverage of President Donald Trump’s events in protest against the exclusion of media outlets from the White House.

The New York Times reported, and U.S. media outlets cited, that the networks received a notification from the department regarding the investigation, which focuses on their collective decision to stop covering White House events under the shared television coverage system, and whether this constitutes a coordinated boycott among competing media organizations in violation of U.S. law.

Emily Covington, a spokesperson for the Department of Justice, confirmed that the antitrust division is investigating to determine whether the media organizations violated relevant laws, explaining that collective boycotts among competing companies may violate the Sherman Antitrust Act. The department has not announced any formal charges against the networks, as the procedure is still in the investigation phase.

The dispute dates back to last September when the Trump administration decided to bar journalists from CNN, MSNBC, and Politico from entering the White House after the president accused these organizations of publishing “fake news.” This decision sparked widespread objections from media organizations, which considered the exclusion of journalists due to their coverage a violation of press freedom and the First Amendment of the U.S. Constitution.

In response to the restrictions, the five networks suspended their joint coverage of the president’s events in a show of solidarity with the excluded organizations. The decision included Fox News, which is widely viewed as being politically closer to Trump, alongside ABC, CBS, NBC, and CNN, before the networks later resumed coverage.

The shared television coverage system at the White House relies on rotating media organizations participating in covering the president’s movements, gathering images and video clips, and distributing them to other media outlets, allowing for coverage of events that cannot accommodate all journalists.

The Department of Justice believes that the collective suspension of this system may raise questions regarding competition rules, while critics of the investigation link the step to the media organizations’ right to take a joint professional stance regarding the restrictions imposed on access to news sources.

The dispute has not been limited to exchanging statements; CNN, MSNBC, and Politico have filed lawsuits against the Trump administration, arguing that their exclusion based on the content of their coverage represents discrimination based on viewpoint and a violation of the First Amendment.

A federal judge ordered in September the reinstatement of the entry privileges for the concerned journalists, considering that the ban appears likely unconstitutional, while disputes continued regarding access to certain events and presidential trips.

The First Amendment of the U.S. Constitution protects freedom of speech and the press, but it does not necessarily grant media organizations unrestricted access to every site or presidential event, as the legal dispute centers around whether the administration’s restrictions are based on legitimate and neutral criteria or whether they were a response to media coverage that the president does not approve of.

The new investigation has drawn criticism from entities concerned with press freedom, warning that using antitrust laws against media organizations for taking a stance in defense of journalistic access rights may raise concerns about influencing media independence. In contrast, the Department of Justice states that the goal of the investigation is to verify compliance with competition rules, not to prejudge the networks.
