أيدت محكمة النقض المصرية اليوم (الثلاثاء)، الحكم الصادر بحق المخرج المصري عمر زهران، بحبسه عاماً مع الشغل، بعد رفض الطعن المقدم منه في القضية المتهم فيها بالاستيلاء على مشغولات ذهبية ومجوهرات تخص الفنانة السعودية التشكيلية شاليمار شربتلي زوجة المخرج المصري خالد يوسف.
حكم نهائي
وبصدور القرار من محكمة النقض، أصبح الحكم نهائياً وباتاً، باعتبارها أعلى جهة قضائية مختصة بنظر الطعون.
رفض الطعن
وكان عمر زهران قد تقدم بطعن على حكم حبسه مطالباً بإلغائه، إلا أن المحكمة قررت رفض الطعن وتأييد العقوبة الصادرة بحقه في القضية المتعلقة بالاستيلاء على مشغولات ومجوهرات مملوكة لشاليمار شربتلي.
تخفيف الحكم في «الاستئناف»
كما نظرت محكمة جنح مستأنف الجيزة القضية رقم 7439 لسنة 2024، وقررت تخفيف الحكم الصادر بحق المخرج عمر زهران من الحبس عامين إلى عام واحد مع الشغل، مع إلزامه بدفع تعويض مدني مؤقت بقيمة 40 ألف جنيه لصالح الفنانة التشكيلية شاليمار شربتلي.
إخلاء سبيل بعد نصف المدة
وكان عمر زهران قد أنهى سابقاً فترة احتجازه بعد صدور قرار بإخلاء سبيله، عقب قضائه نصف مدة العقوبة وفقاً للإفراج الشرطي، ونقل من محبسه بالقاهرة إلى قسم شرطة الدقي لاستكمال الإجراءات القانونية والفحص الجنائي، قبل الانتهاء من أوراق خروجه ومغادرته القسم بشكل رسمي.
The Egyptian Court of Cassation upheld today (Tuesday) the ruling against Egyptian director Omar Zahran, sentencing him to one year in prison with hard labor, after rejecting his appeal in the case where he is accused of seizing gold jewelry and possessions belonging to Saudi artist Shalimar Sherbatly, the wife of Egyptian director Khaled Youssef.
Final Ruling
With the issuance of the decision by the Court of Cassation, the ruling has become final and conclusive, as it is the highest judicial authority competent to consider appeals.
Appeal Rejected
Omar Zahran had filed an appeal against his prison sentence, requesting its cancellation; however, the court decided to reject the appeal and uphold the penalty issued against him in the case related to the seizure of possessions and jewelry owned by Shalimar Sherbatly.
Sentence Reduced in “Appeal”
The Giza Misdemeanor Appeals Court also reviewed case number 7439 for the year 2024 and decided to reduce the sentence against director Omar Zahran from two years in prison to one year with hard labor, while obligating him to pay a temporary civil compensation of 40,000 Egyptian pounds to the artist Shalimar Sherbatly.
Release After Half the Sentence
Omar Zahran had previously completed his detention period after a decision was made for his release, following the completion of half of his sentence according to conditional release. He was transferred from his detention in Cairo to the Dokki police station to complete the legal procedures and criminal examination before finalizing his release papers and officially leaving the station.
